HomeMy WebLinkAbout~Master - Transfer of cell tower site leases on City property RESOLUTION NO. 14-044 RESOLUTION APPROVING TRANSFER OF CELLULAR SITE LEASES ON CITY PROPERTY FROM T-MOBILE TO IOWA WIRELESS SERVICES FOR THE CITY OF AMES,IOWA WHEREAS, several cellular providers have contracts to place private cellular network equipment on City property,and one of these locations is Homewood Golf Course,where T-Mobile and its affiliates have a free-standing antenna; and, WHEREAS,another location is the Bloomington Road Elevated Tank(BRET)Water Tower, where T-Mobile antennas are attached to the tower's structure; and, WHEREAS, both of these agreements were originally signed in December 1996, and both had five-year terms, which automatically renew at five-year intervals for 30 total years; and, WHEREAS,the current renewals expire on December 31,2016,and may renew twice more (until year 2026); and, WHEREAS,T-Mobile has entered into an agreement with Iowa Wireless Services,LLC,to assign its interest in these two lease agreements; and, WHEREAS,Iowa Wireless Services would assume the responsibility to make payments and perform the activities outlined in the original leases, and the City has been asked to consent to this transfer between T-Mobile and Iowa Wireless Services. NOW, THEREFORE,BE IT RESOLVED,by the City Council of the City of Ames, Iowa, that the transfer of the lease for cellular antennas at Homewood Golf Course and the BRET Water Tower from T-Mobile to Iowa Wireless Services, LLC, is hereby approved.
