ACTION FORM SUMMARY: The applicant, Haverkamp Properties, is requesting that the City Council approve the Final Plat of the Delaware Heights Subdivision. Staff is recommending that this Final Plat be approved. BACKGROUND: The applicant, Haverkamp Properties, is requesting that the City Council approve the Final Plat of the Delaware Heights Subdivision. The proposed subdivision includes the creation of three lots that range in size from .18 acres to .27 acres. The lots are zoned R-2, Residential Low Density, and front on Delaware Avenue and North Dakota Avenue. It is the understanding of staff that the owner of the lots is proposing to construct two-unit residential structures on each of the three lots. Access to the lots is limited to Delaware Avenue, therefore there is a need for a cross easement for two of the lots to have access to Delaware Avenue. The proposed lots meet the existing zoning requirements of the City. ANALYSIS: Staff has reviewed the Final Plat and has determined that the Final Plat meets the requirements of the subdivision regulations of the City. The required public improvements for this subdivision already exist, since this is a minor subdivision that is dividing a lot that already exists and has water and sewer service, plus street access as proposed from Delaware Avenue. The Final Plat for the Delaware Heights Subdivision is proposing to create an ingress/egress easement across Lot 1 for Lots 2 and 3 and across Lot 3 for Lot 2. This is an easement between the three lots and does not directly affect the City. This easement document has been signed and will become part of the documents that are approved as part of this Final Plat. Based on this review and the fact that this Final Plat meets the requirements of the City, staff is recommending that this Final Plat be approved (a copy of the Final Plat is attached for your review). ALTERNATIVES: 1. The City Council can approve the Final Plat of the Delaware Heights Subdivision. 2. The City Council can approve the Final Plat of the Delaware Heights Subdivision with modifications. 3. The City Council can deny approval of the Final Plat of the Delaware Heights Subdivision. MANAGER'S RECOMMENDED ACTION: It is the recommendation of the City Manager that the City Council adopt Alternative #1. This action will approve the Final Plat of the Delaware Heights Subdivision.
