SUBJECT: Request for waiving the installation of sidewalks f ►can
,jrEafffe-0169ubdivision.
BACKGROUND:
The sidewalk system in any City is a very important part of the whole
public transportation system. The sidewalk is a hard-surfaced safety
feature paralleling streets which allows pedestrians a place to walk without
conflicting with vehicular traffic. In the City of Ames, the Subdivision
Ordinance requires that sidewalks be installed as plat improvements where
any lot abuts a street right-of-way.
During the June 25 Council meeting, the City Council received a request
from the developer of Dearborn Estates Subdivision to waive the
installation of sidewalks on Chelsea Court. The developer did not ask the
Council to waive the installation of sidewalks on North Dakota Avenue and
Delaware Avenue because .the developer felt these sidewalks were the
responsibility of the City. The developer has indicated to staff that if he
is responsible for the sidewalks along North Dakota Avenue and Delaware
Avenue, he would request that the Council waive the installation of these
sidewalks also.
The attached map of the area of this subdivision shows the layout of the
existing sidewalk. As new development occurs along Delaware Avenue
sidewalk will be installed as required by the Subdivision Ordinance. Many
gaps in the sidewalk network will gradually be eliminated as this occurs.
Allowing this developer to not install all of the sidewalk as required by the
Subdivision Ordinance creates more gaps and would force pedestrians to
use the street.
Installing sidewalk on Chelsea Court requires that some trees be removed
and additional placement of fill be installed. Along Delaware Avenue and
North Dakota Avenue the sidewalks can be installed without any extra
work.
ALTERNATIVES
1. Enforce the Subdivision Ordinance and not grant the developer's
request to waive installation of sidewalks along North Dakota
Avenue, Delaware Avenue and Chelsea Court.
2. Grant the developer's request to not install sidewalks along North
Dakota Avenue, Delaware Avenue and Chelsea Court.
MANAGER'S RECOMMENDED ACTION:
It is recommended by the City Manager that the City Council adopt alter-
native number 1 above, thereby enforcing the Subdivision Ordinance and
not granting the developer's request to waive installation of sidewalk along
North Dakota Avenue, Delaware Avenue and Chelsea Court.
