ACTION FORM SUMMARY: Dayton Park L.L.C. is requesting that the requirement to install sidewalks in the Dayton Park Subdivision 3rd Addition be waived on one side of the street that is being installed. Previously a request was made to the City Council to waive the requirement for sidewalks in total. The City Council denied that request. Staff is recommending that the request to waive the sidewalk requirement for installation of sidewalks on both sides of the street and allow sidewalks to be installed on one side of the street of Dayton Park Subdivision 3rd Addition be denied. BACKGROUND: The owners of the property described as Dayton Park Subdivision 3rd Addition are requesting that the City Council waive the requirement for the installation of sidewalks on both sides of the street, which is proposed to be installed as part of the Subdivision. The owners are proposing to install the sidewalk on only one side of the street (see the attached copy of their letter). The owners of the property in question previously requested that the entire requirement for the installation of sidewalks be waived. The City Council denied that request at the City Council meeting of February 22, 2000. ANALYSIS: Dayton Park Subdivision 3rd Addition involves the installation of approximately 500 to 600 lineal feet of street. This length represents approximately two standard block lengths, which is not a significant length. The amount of sidewalk to be installed with this Subdivision is therefore not a significant length. As stated earlier, the property owner had previously requested that this requirement be waived in its entirety. That request was denied. The City Council has determined that sidewalks are an important component of the transportation mobility within the City. This policy is clearly emphasized in the Transportation Plan that is in the process of being finalized. The request to install sidewalks on one side of the street appears to recognize the importance of pedestrian , mobility, but to a limited degree. In reviewing the Subdivision that has been approved, it is not clear which side of the street would generate more or less pedestrian traffic. Since pedestrian mobility is an important element of mobility within the City, staff cannot recommend that sidewalks be eliminated from one side of the street in this Subdivision (a copy of the Plat for this area is attached). ALTERNATIVES: 1. The City Council can approve the request from Dayton Park L.L.C. to waive the requirement for the installation of sidewalks on both sides of the street and allow sidewalks to be installed on one side of the street. 2. The City Council can deny the request from Dayton Park L.L.C. to waive the requirement for the installation of sidewalks, which would require the sidewalks to be constructed on both sides of the street. 3. The City council can refer this request back to staff for additional information. MANAGER'S RECOMMENDED ACTION: It is the recommendation of the City Manager that the City Council adopt Alternative #2. This action will deny the request to waive the requirement to install sidewalks on both sides of the Street within the Dayton Park Subdivision 3" Addition and allow the walks to be installed on only one side of the street. Pedestrian mobility is an important means for citizens to move about the City and sidewalks are needed to accomplish this objective. The City has renewed a commitment to provide for this type of mobility and there is little justification to not provide for pedestrian mobility in this part of the City. Our initial request to have the sidewalks waived altogether was denied. We are hopeful that the waiver of one side of the street is a reasonable compromise to both the developer and the City of Ames.
