COUNCIL ACTION FORM
SUBJECT: RESOLUTION APPROVING PARTIAL COMPLETION OF PUBLIC
IMPROVEMENTS AND RESOLUTION APPROVING THE FINAL PLAT OF DAYTON
PARK SUBDIVISION, THIRD ADDITION.
ACTION FORM SUMMARY: The applicant, Dayton Park L. L. C., is requesting that the
City Council accept the completion of a portion of the public improvements and approve
the Final Plat of the Dayton Park Subdivision, 3rd Addition.
Staff is recommending that this Final Plat be approved.
BACKGROUND:
The applicant Dayton Park L.L.C. is requesting that the City Council approve the Final Plat
of Dayton Park Subdivision, 3rd Addition. The proposed subdivision includes two
developable lots and two outlots. One of the outlots will remain unbuildable since it is the
location for a surface water flowage/storage. The other outlot is the undivided remnant of
the original parcel that will likely be further subdivided in the future. (A copy of the Final Plat
of the proposed subdivision is attached for review by Council.)
The in question is zoned G-I General Industrial). The buildable lots are 1.75 an

2.27 acres in size, which meets the zoning requirements. It is staffs understanding that
one of the buildable lots is being considered for a location for commercial rental space and
possible storage space. The unbuildable outlots are six (6) acres and 37.2 acres in size.
The buildable lots will front on an extension of South Bell Avenue and will have access to
the necessary infrastructure that will be installed as part of this subdivision.
ANALYSIS:
The staff has reviewed this proposed subdivision and has determined that it complies with
the subdivision requirements of the City. The developer is requesting that the City Council
approve the installation of storm sewer improvements that have already been installed. The
developer has yet to install the required water mains, sanitary sewer mains, electrical
improvements, street lights, street improvements, and sidewalks. The construction plans
and specifications for the improvements that are yet to be installed have been reviewed
and approved by the Public Works Department. The developer has provided a Letter of
Credit in an amount sufficient to insure that these improvements will be installed. In
addition, the developer has also signed a Public Improvement Agreement that serves to
guarantee the installation of the remaining infrastructure.
Based on this review, staff has determined that the proposed
Final Plat for the Dayton Park Subdivision, V Addition has met the subdivision
requirements of the City. Staff is recommending that the partial completion of the
improvements that includes the storm sewer facilities be accepted and that the Final Plat
be approved.
ALTERNATIVES:
1. The City Council can accept the completion of the storm sewer improvements and
approve the Final Plat of the Dayton Park Subdivision, 3rd Addition.
2. The City Council can accept the completion of the storm sewer improvements and
approve the Final Plat of the Dayton Park Subdivision, 3rd Addition with modifications.
3. The City Council can deny approval of the Final Plat of the Dayton Park Subdivision,
3rd Addition.
MANAGER'S RECOMMENDED ACTION:
It is the recommendation of the City Manager that the City Council adopt Alternative #1.
This action will approve the completion of the storm sewer improvements and approve the
Final Plat of the Dayton Park Subdivision, 3' Addition.
