hereby acknowledged, does hereby grant unto the CITY OF AMES, IOWA, a municipal
corporation,its successors and assigns,the perpetual right to construct,reconstruct,maintain,repair
and use utility services and apparatus upon, underground, over and across the following-described
real estate:
The East 15.00 feet of Outlot Z lying parallel with and adjacent to the
West Right-of-Way Line of Iowa Interstate Hwy. No. 35, as it is
presently established; AND,

the following-described real estate:

A Portion of Outlot Z described as Beginning at the Northeast Corner
of Lot A; thence, N89°55'36"W along the North Line of Lot A and
Lot 2 a distance of 116.00 feet; thence, N00°04'24"E a distance of
40.00 feet;thence, S89°5536"E along a line parallel with and 40.00
feet North of the North Line of Lot 2 and Lot A a distance of 116.00
feet; thence S00°04'24"W a distance of 40.00 feet to the Point of
Beginning,

A perpetual easement for sanitary sewer and water main is granted over and across the
following-described real estate:
The South 40.00 feet of Outlot Z lying parallel with and adjacent to
the South Line of the Southwest Fractional 1/4 of Section 7,
Township 83 North, Range 23 West, of the 5th P.M., Ames, Story
County, Iowa.
all of the foregoing in Dayton Park Subdivision Third Addition,City of Ames, Story County,Iowa.
The foregoing rights are granted upon the express condition that the users of the granted
rights will assume liability for all damage to the real estate described herein and any adjacent real
estate caused by the failure to use due care in the exercise of the granted rights.
