TO WAIVE THE REQUIREMENT FOR THE INSTALLATION OF SIDEWALKS IN THE DAYTON PARK SUBDIVISION, THIRD ADDITION. ACTION FORM SUMMARY: Dayton Park L.L.C. is requesting that the requirement for the installation of sidewalks in the Dayton Park Subdivision, Third Addition be waived. Section 23.403(14)(c) requires that sidewalks be constructed in the public right-of-way on each side of any street. Staff is recof trending that the sidewalk requirement not be waived and that the sidewalks be installed as part of this Subdivision. BACKGROUND: In January of 2000, the City Council approved the Preliminary Plat of the Dayton Park Subdivision, Third Addition. This proposed Subdivision creates 10 lots that are zoned G-1 (General Industrial) in two phases. The first phase creates two lots that will have access and frontage on the west side of south Bell Avenue. When the City Council took action to approve the Preliminary Plat, no action was taken with respect to the request from the developer to waive the requirement for the installation of the sidewalks. The developer had previously requested that this sidewalk requirement be waived (see attached letter dated December 3, 1999). The developer is again requesting that the sidewalk requirement be waived (see attached letter dated February 7, 2000). ANALYSIS: The developer is requesting that the requirement for sidewalks be waived in this Subdivision since other Subdivisions in the area (Dayton Park, 1st and 2"d Additions and the Subdivisions included within the Ames Community Development Park) have been developed without sidewalks. With the newly adopted Subdivision regulations that clearly require sidewalks on both sides of streets in platted Subdivisions and the emphasis that exists in the "draft" Transportation Plan for sidewalks, staff believes that sidewalks should be installed in this Subdivision. In addition, the development of the lots in the Dayton Park Subdivision, 1st and 2"d Additions has included the construction of two motel facilities, which will result in guest lodging with a need for off-street sidewalk facilities. It is true that several previous Subdivisions in this area have been approved that do not contain sidewalk improvements. The City may, in the future, have to install sidewalks through a CIP project or a Special Assessment project, if the need arises. Without sidewalk improvements the City is limiting the mobility options of employees or guests in this area to vehicular transportation or a need to walk in the street. Staff believes that other mobility options, which include pedestrian mobility, are needed in this area. Therefore, staff is recommending that the request to waive the sidewalk requirement for Dayton Park Subdivision, Third Addition not be approved. ALTERNATIVES: 1. The City Council can deny the request from Dayton Park L.L.C. to waive the requirement for the installation of sidewalks in the Dayton. Park Subdivision, Third Addition. 2. The City Council can approve the request from the Dayton Park L.L.C. to waive the requirement for the installation of sidewalks in the Dayton Park Subdivision, Third Addition. MANAGER'S RECOMMENDED ACTION: It is the recommendation of the City Manager that the City Council adopt Alternative #1. This action will deny the request from Dayton Park L.L.C. to waive the requirement for the installation of sidewalks in the Dayton Park Subdivision, Third Addition. The City Council has placed an emphasis on creating options for mobility within the City and sidewalks within Subdivisions are an effective method of accomplishing this objective. Section 23.401.(2) BLOCKS As you know SE 16th extends east of South Dayton Avenue approximately 1500 feet without a cross street intersection. It is at the east end of the existing SE 16th Street where the Dayton Park Subdivision Third Addition public improvements begin. At this point the subdivision regulations which limit blocks to a maximum length of 1320 feet has already been exceeded. With your approval, Dayton Park Subdivision Third Addition will include the construction of South Bell Avenue which will begin on the east end of SE 16th, turn north immediately, and extend across Dayton Park Subdivision for a length of approximately 1320 feet again without the benefit of cross streets. This area in the City of Ames is situated adjacent to I-35 and US Hwy 30 which leaves no opportunity to develop cross streets to the south or the east. In addition, this area is flood prone and it has become necessary to incorporate a large detention pond in the center of the project which eliminates the opportunity to develop cross streets to the north or west. With your approval, this project will be able to commence and South Bell Avenue will be one step closer to becoming a through street, opening up a substantial area to commercial and industrial development. Section 23.403.(14) SIDEWALKS AND WALKWAYS Dayton Park Subdivision is located in an area of the City of Ames where sidewalks have not been incorporated into the developments. The industrial area on Bell and Alexandria south of East Mayor Tedesco December 3, 1999 Page Two Lincoln Way has been developed without sidewalks. Similarly, Dayton Park Subdivision 1 st and 2nd Additions and the area to the south of SE 16th Street have been developed without sidewalks. This area of the City of Ames is tucked down into the southeast corner of the city up against I-35 and US Hwy 30. Walks, if required in this subdivision would be isolated and utilized very little. It follows that this project should continue without sidewalks. Thank you for your consideration of these requests.
