Dear Sirs:
We would like you to consider the following facts before making a final decision on the
sidewalks for Dayton Park 3`d Addition:
1. This is an industrial zone. Most of the people that will be coming here will be
going to a specific place of business or office to work. The office building that
we are going to build will not be a shopping center. Since restaurants and
entertainment establishments are prohibited by the zoning ordinance, the amount
of pedestrian traffic will be minimal.
2. The developers do not want to discourage the marketability of the building. If
the developers are forced to put in sidewalks, it will drive up not only the cost of
the initial rent but also the cost of the C.A.M. charges that the tenants will have
to pay on an annual basis. Also, there is additional liability associated with
several hundred feet of sidewalk.
The staff summary makes the comment that the City may, in the future, have to install
sidewalks through a CIP project or a special assessment. I have attached some pictures to
show the difficulty in accomplishing such a project in this particular area.
I question if the new zoning ordinance really intended for sidewalks to be in the industrial
zones. According to the new subdivision regulations, "sidewalks and walkways shall be
designed to provide convenient access to all properties and shall connect to the city-wide
sidewalk system." Since this is impossible to do since there are no sidewalks in the area
or in any other industrial area in town, we ask that you grant the sidewalk waiver.
