RESOLUTION NUMBER 97-516
ACCEPTING PLAT
WHEREAS, there has been submitted to the City Council of the City of Ames, Iowa,
a plat of real estate described as:
An irregularly shaped portion of the South Half (S 1/2) of the Southwest
Fractional Quarter (SW Frl. 1/4) of Section Seven (7), Township Eighty-
three (83) North, Range Twenty-three (23) West of the 5th P.M., Ames, Story
County, Iowa, lying West of the Westerly right-of-way line of Iowa Interstate
Highway No. 35, East of the Easterly right-of-way line of Dayton Avenue in
the City of Ames, Iowa, and South and East of First Addition, Dayton Park
Subdivision, Ames, Iowa, more accurately described as follows: Commencing
at the Southwest Corner (SW Cor.) of the Southwest Fractional Quarter (SW
Frl. 1/4) of Section Seven (7), Township Eighty-three (83) North, Range
Twenty-three (23) West of the 5th P.M., Ames, Story County, Iowa, thence
North 89°17'53"East along the South line of the Southwest Fractional Quarter
(SW Frl. 1/4) of said Section Seven (7) a distance of 80.01 Feet to the East
right-of-way line of Dayton Avenue as it is presently established and to the
point of beginning, thence North 00°04'24"East along the Easterly right-of-
way line of said Dayton Avenue a distance of 280.00 Feet to the Southwest
Corner (SW Cor.) of First Addition, Dayton Park Subdivision, Ames, Iowa,
thence North 89°17'50" East along the South line of said First Addition,
Dayton Park Subdivision, Ames, Iowa, a distance of 500.00 Feet to the
Southeast Corner (SE Cor.) of said First Addition, Dayton Park Subdivision,
thence North 00°04'24"East along the East line of said First Addition, Dayton
Park Subdivision, a distance of 1,033.90 Feet to the Northeast Corner (NE
Cor.) of said First Addition, Dayton Park Subdivision, and to the North line
of the South Half (S 1/2) of the Southwest Fractional Quarter (SW Frl. 1/4)
of said Section Seven (7), thence North 89°22'04"East along the North line
of the South Half (S 1/2) of the Southwest Fractional Quarter (SW Frl. 1/4)
of said Section Seven (7), a distance of 1,995.41 Feet to the Westerly right-

of-way line of Iowa Interstate Highway No. 35 (1-35) as it is presently
established, thence South 04°42'38"West along the Westerly right-of-way line
of said I-35 a distance of 161.84 Feet, thence South 16°47'28"West along the
Westerly right-of-way line of said I-35, a distance of 652.27 Feet, thence South
38°45'56"West along the Westerly right-of-way line of said I-35 a distance of
240.01 Feet, thence South 45°08'38"West along the Westerly right-of-way line
of said I-35 a distance of 397.12 Feet, thence South 45°09'00"West along the
Westerly right-of-way line of said I-35, a distance of 100.63 Feet to the South
line of the Southwest Fractional Quarter (SW Frl. 1/4) of said Section Seven
(7), thence South 89°17'53" West along the South line of the Southwest
Fractional Quarter (SW Frl. 1/4) of said Section Seven (7) a distance of
1,788.60 Feet to the point of beginning, said tract of land contains 56.479
acres, more or less,
to be known as SECOND ADDITION,DAYTON PARK SUBDIVISION,AMES,IOWA,and
WHEREAS, the plat has been submitted to the Planning and Zoning Commission
and it has acted thereon as provided by law, and
WHEREAS, the owner of said real estate, Dayton Park, L.L.C., an Iowa limited
liability company, has executed a written Consent and Dedication declaring that the platting
is with its free consent and is in accordance with its desire as proprietor, and
WHEREAS, the owner has complied with all conditions as set forth in the
ordinances of the City of Ames, Iowa, and the laws of the State of Iowa,
WHEREAS, it is the opinion of the City Council of the City of Ames, Iowa, that the
plat should be approved,
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Ames,
Iowa, that the plat of SECOND ADDITION, DAYTON PARK SUBDIVISION, AMES,
IOWA, be and it is hereby accepted and approved, and

BE IT FURTHER RESOLVED that all acts of Dayton Park, L.L.C., as grantor
in the premises, are hereby confirmed and approved,
BE IT FURTHER RESOLVED that the dedication of Lot "A" and the most
southerly 40.00 feet of Outlot 'Y" within said plat for the perpetual use of the public for
public street purposes be and the same is hereby accepted for and on behalf of the City of
Ames, Iowa, and all acts of Dayton Park, L.L.C., are hereby confirmed and approved by the
City Council of the City of Ames, Iowa, on this 14th day of
October , 1997.
BE IT FURTHER RESOLVED that the Mayor and the City Clerk are directed to
certify the Resolution affixed to the plat. �,ry

We, Larry R. Curtis and Sandra L. Ryan, being the duly elected and appointed
Mayor and City Clerk, respectively, of the City of Ames, Iowa, do hereby certify that the
above and foregoing Resolution Number 97-516 is a true and accurate copy of
said Resolution; that said Resolution was duly passed and adopted by the City Council of
the City of Ames, Iowa, at a duly convened meeting thereof on the 14th day of
October , 1997.
