RESOLUTION NO. 20-242
RESOLUTION APPROVING VACATION OF STORMWATER RETENTION
EASEMENT ACROSS PORTIONS OF 2ND' 3RD, 4TH, AND 5TH ADDITIONS
OF DAYTON PARK SUBDIVISION
FOR THE CITY OF AMES,IOWA
WHEREAS,there is an existing storm sewer,surface water flowage,and surface water storage
and retention easement of the property located over portions of 2na 3`a,4t",and 5t",Additions of Dayton
Park Subdivision; and,
WHEREAS,the property owner made a request to vacate the easement; and,
WHEREAS, pursuant to Iowa Code Section 364.7, notice was given on April 28, 2020, and a
public hearing is being held regarding the proposal of the City to vacate the easement; and,
WHEREAS, vacation of the easement is in the best interest of the City.
NOW,THEREFORE,BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
AMES,IOWA THAT:
1. Pursuant to Iowa Code Section 364.7, publication of notice regarding the proposed
vacation of the public utility easement and establishing a public hearing date regarding the proposal has
been made.
2. The public hearing regarding the disposition of the property is hereby closed.
3. The existing storm sewer,surface water flowage,and surface water storage,and retention
easement across the following described land is hereby vacated,;
That part of the South 1/2 of the Southwest 1/4 of Section 7, Township 83 North,
Range 23 West, lying West of Interstate 35, except the West 580 feet and South 40 feet thereof.
