HomeMy WebLinkAbout~Master - Proposed vacation of public utility easement at 2801 East 13th Street DO NOT WRITE IN THE SPACE ABOVE THIS LINE,RESERVED FOR RECORDER Prepared by:Judy K.Parks,City Attorney,515 Clark Avenue,Ames,IA 50010 Phone:515-239-5146 Return to:Ames City Clerk,P.O.Box 811,Ames,IA 50010 Phone:515-239-5105 RESOLUTION NO. 13-498 RESOLUTION PROPOSING VACATION OF PUBLIC UTILITY EASEMENT AT 2801 EAST 13TH STREET AND SETTING DATE OF PUBLIC HEARING FOR THE CITY OF AMES,IOWA WHEREAS, the engineering firm representing Kum&Go at 2801 East 131h Street has made a request to vacate the public utility easement running north/south through the existing lot; and, WHEREAS,the vacation is requested in order for the property owners to move forward with the process to expand their existing store,and this request was originally planned to be presented to Council at the April 9, 2013, meeting; and, WHEREAS, at that time, staff had not yet received a response from all utility users as to the existence or potential use of the existing easement, so this item was pulled from the Council agenda; and, WHEREAS, Public Works staff has now received responses from all registered right-of-way users as to the extent of utilities in this immediate area and any intention to utilize the existing easement; and, WHEREAS, the only affected utility is Century Link; and, WHEREAS, the property owner has agreed to maintain a 10-foot easement over the portion occupied by Century Link; and, WHEREAS,none of the other utility owners have an existing use or any plans to use the current public utility easement. NOW, THEREFORE,BE IT RESOLVED by the City Council of the City of Ames,Iowa,that November 26, 2013, is hereby set for the date of public hearing to vacate the westerly 30 feet of the existing public utility easement at 2801 East 13th Street, while maintaining the easterly 10 feet of the existing easement.
