COUNCIL ACTION FORM
SUBJECT: APPROVE/REJECT REQUEST FOR CITY PARTICIPATION IN STORM
SEWER WORK IN CONJUNCTION WITH THE DAYTON INDUSTRIAL PARK
SUBDIVISION
BACKGROUND:
Council referred a request from Jon Chester for the City to participate in the
underground piping of an open drainage way along the north side of their proposed
Dayton Industrial Park Subdivision. The drainage way carries stormwater runoff from
the north and east. The drainage way was in existence when the area was strictly
agricultural and prior to any area development. As development took place, the
drainage from the east was controlled through the use of a detention pond such that the
runoff rate was not increased by the development up stream. The outlet from the
detention pond was placed into the existing drainage way. The attached grading plan
for the area shows the drainage way.
The Developers of the subdivision, the Armstrong Family Trust, believe that the City
should participate in the drainage way enclosure, expected to cost about $30,000,
because a portion of the runoff is coming from the City-controlled detention basin. The
enclosure of the drainage way will benefit the Developers since more of Lot 3 will be
buildable. Because the proposed drainage way enclosure only deals with private
property, no public gain is made by enclosing the drainage way. Even if the drainage
way is enclosed, a swale must be incorporated so that stormwater runoff flows of larger
magnitudes than the pipe capacity can be handled. It is important that any work that is
done to the drainage way does not further impact adjoining properties. At the point of
design of whatever improvements are going to be accomplished, staff will insure that
the property owners to the north are not impacted.
Over time, the Armstrong Family Trust has moved the drainage way north. Originally
the drainage connected directly with a 48" culvert under Dayton Avenue. Since the
Developers have modified the drainage way previously, it should remain their
responsibility to continue to deal with it.
ALTERNATIVES:
1 . Reject the request for City participation in the underground piping and
modifications to the drainage way in the Dayton Industrial Park Subdivision.
2. Approve the request for City participation not to exceed one-half of the cost of the
piping materials. This potential cost (approximately $10,000) is not budgeted.
MANAGERS RECOMMENDED ACTION:
Because there is no public gain from City participation in the drainage way piping
proposal, it is recommended by the City Manager that the City Council accept
alternative number one above and reject the request for City participation in the
underground piping and modifications to the drainage way in the Dayton Industrial Park
Subdivision.
