HomeMy WebLinkAboutA021 - Council Action Form dated October 22, 2002 - Item 30a 2 ITEM # 30 ao, DATE 10/22/02 COUNCIL ACTION FORM SUBJECT: RESOLUTION APPROVING/MOTION DENYING A REQUEST TO WAIVE THE REQUIREMENT OF SIDEWALK INSTALLATION IN THE DAYTON INDUSTRIAL PARK SUBDIVISION. BACKGROUND: The developers of the proposed Dayton Industrial Park Subdivision have requested that the requirement for the installation of sidewalks be waived with respect to this subdivision (See attached copy of the Preliminary Plat). The requirement for the installation of sidewalks is provided for in Section 23.403(14)(a)of the Subdivision Regulations states: "Sidewalks and walkways shall be designed to provide convenient access to all properties and shall connect to the City-wide sidewalk system. A minimum of a four-foot wide concrete sidewalk shall be installed in the public right-of-way along each side of any street. Such a sidewalk shall connect with any sidewalk within the area to be subdivided and with any existing or proposed sidewalk in any adjacent area. Any required sidewalk shall be constructed of concrete and be at least four feet wide." Clearly, the subdivision regulations require the installation of sidewalks. The adopted Transportation Plan, which contains the transportation policies of the City Council, indicates that every citizen should have at least one mode of travel option available to them (Page 30 Transportation Plan). Furthermore, one of the transportation objectives of the City Council is to enhance the opportunity for expanding the role of transportation modes other than the auto for trips, including pedestrian travel, bicycles, and public transportation (Page 31 Transportation Plan). The justification provided by the developer to waive the sidewalk requirement includes the following: 1. The development is planned for large lots with industrial users and there will be little or no pedestrian traffic. • The sizes of the lots range in size from .69 acres to 1.81 acres. In relation to patterns of industrial development elsewhere in the City, these are relatively small industrial lots. No additional documentation has been provided to substantiate that there is not nor will there be pedestrian traffic. r j 2. The cost of installing sidewalks could range from $2,500 to $5,000 per lot. • It is not clear whether this estimated cost is out of line with respect to cost for other industrial lots in the area. Furthermore, the City of Ames is already in the process of securing financial assistance to aid in offsetting the cost of street improvements for this subdivision. If the grant funds are received,there does not appear to be unreasonable costs associated with the development of this property. 3. Similar projects in the area have been developed where walk improvements have been waived. • It is true that other subdivisions in the area have been developed without walkway improvements. Examples of these subdivisions include: Ames Community Development Park, 1st Addition and 2"d Addition, as well as the Dayton Park Subdivision, 3rd Addition. The requirement for sidewalks in these subdivisions has been waived by the City Council. With the adoption of the Transportation Plan that focuses on multi-modal transportation, it could be argued that the requirement of sidewalks has taken on renewed importance in terms of an important transportation alternative. Additionally,the requirement for the installation of sidewalks is not a new requirement. Sidewalks have been a part of subdivision improvements in the City for many years with varying degrees of consistency in the application of the requirement. ALTERNATIVES: 1. The City Council can approve the request to waive the requirement to install sidewalks in the Dayton Industrial Park Subdivision. 2. The City Council can deny approval of the request to waive the requirement to install sidewalks in the Dayton Industrial Park Subdivision. 3. The City Council can refer this request back to staff and/or the applicant for additional information. MANAGER'S RECOMMENDED ACTION: Staff believes the adopted regulations of the City Council and the adopted Transportation Plan indicate that the City Council believes that pedestrian transportation is a viable means of mobility. Therefore, it is the recommendation of the City Manager that the City Council approve Alternative #2. This will deny the request to waive the requirement to install sidewalks in the Dayton Industrial Park Subdivision. This will require the installation of sidewalks as part of the subdivision improvements for this industrial subdivision.
