City Attorney September 1, 1978 Honorable Lee Fellinger, Mayor And Members of the City Council Of The City of Ames, Iowa In Re : Dayton Park Subdivision (Industrial) Dear Mayor Fellinger and Council Members: on the agenda for the Council meeting of September 5 is a letter from Dean Hunziker which presents certain questions with respect to improvement of South 16th Street east of Dayton Road. This matter was discussed briefly between the Mayor, the City Manager, Mr. Hunziker and myself Thursday afternoon, August 31 . As a result of that discussion, it is my conclusion, shared I believe by the Mayor and City Manager, that the best approach to financing the improvement of South 16th Street is by special assessment. There are , however, two difficulties with that approach. First, the property owners south of South 16th Street can be expected to protest an assessment since they appear to be planning on a private frontage road along the north side of U.S. 30 as a means of access to their property, and not South 16th Street. Secondly, there is the matter of acquiring the land for the additional 14 feet of width needed to bring the 66 foot wide South 16th Street up to the 80 feet of width required by city street standards . This additional width could be acquired as 7 feet from the north side and 7 feet from the south side, but not without considerable expense and possibly eminent domain proceedings on the south side. Another approach would be to require the subdivider on the north side of the street to dedicate all 14 feet of the required additional width as a condition for approval of the plat. Combining Education and Industry with Hospitality ` 5 -2_ All of these matters need to be studied and developed more thoroughly by the City staff. However, it is felt by both the staff and Mr. Hunziker that some policy guidance from the City Council is necessary at this juncture. Respectfully submitted, John R. Klaus City Attorney cc T.V.
