HomeMy WebLinkAboutA007 - Attorney's Title Opinion dated March 13, 2000 ATTORNEY'S TITLE OPINION Fourth Addition,Dauntless Subdivision,Ames,Iowa I,Franklin J.Feilmeyer, state: 1. 1 am an attorney licensed to practice law in the State of Iowa. My principal place of business is located at 618 Douglas Ave.,P.O.Box 270,Ames,IA 50010-0270 (Telephone: 515-239-5000). 2. In accordance with section 3 54.11 of the Code of Iowa, I have examined the abstract of title to the real property described in the attached Consent, shown in the subdivision plat, and to be known as Fourth Addition,Dauntless Subdivision,Ames,Iowa. 3. Based on such examination,I find that fee simple title to: 3.1. Outlot"Q"is vested in JENSEN DEVELOPMENT CORPORATION,LTD. 3.2. Outlot "R' is vested in EVERETT W. COCHRANE and MARJORIE L. CO- CHRANE. 3.3. The south 50 feet of Outlot"S" and Outlot"U" is vested in ERBEN A.HUNZIKER as Trustee of the ERBEN A.HUNZIKER REVOCABLE TRUST dated July 28,1992. 3.4. Outlots"V"and"W'is vested in TERRA FIRMA,L.P. 4. Based on such examination, I find that the following are holders of mortgages, liens, or other en- cumbrances on said real property being platted: 4.1. Outlot"Q"was mortgaged by Jensen Development Corporation,LTD,to Moore Proper- ties and Development, LLC, to secure an original indebtedness of $360,000.00 by a mortgage under date of March 26, 1999, filed in the office of the Recorder of Story County,Iowa,on March 30, 1999,and recorded as Instrument N°99-04132. 4.2. Outlot "Q" was mortgaged by Jensen Development Corporation, LTD, to William A. Moore to secure an original indebtedness of$90,000.00 by a mortgage under date of July 23, 1999,filed in the office of the Recorder of Story County, Iowa, on July 23, 1999,and recorded as Instrument N°99-09963. 4.3. Outlot"R' was sold by Everett W. Cochrane and Marjorie L. Cochrane under a contract for deed to Dickson D. Jenson and Luann C. Jensen by a contract under date of Sep- tember 19, 1997,filed in the office of the Recorder of Story County,Iowa,on October 16, 1997, and recorded as Instrument N°97-11162,who assigned their interests in said con- tract to Jensen Development Corporation, LTD., by an assignment dated March 5, 1998,filed in the office of the Recorder of Story County, Iowa, on March 17, 1998, and recorded as Instrument N°98-03191.
