HomeMy WebLinkAboutA004 - Mortgagee's Consent to Platting and Partial Release dated March 13, 2000 MORTGAGEE'S CONSENT TO PLATTINGAND PARTIAL RELEASE Fourth Addition,Dauntless Subdivision,Ames,Iowa WHEREAS,Moore Properties and Development,LLC(the"Mortgagee")the present owner of the mortgage given by Jensen Development Corporation, LTD., to Moore Properties and Development, LLC, under date of March 26, 1999,and filed in the office of the Recorder of Story County, Iowa, on March 30, 1999, and recorded as Instrument N° 99-04132, and therefore, Mortgagee has an interest in the real prop- erty described in the consent to platting to which this Mortgagee's Consent to Platting is attached; WHEREAS, the Mortgagee has been requested to consent to the platting of the real property de- scribed in the attached subdivision plat to be known as Fourth Addition,Dauntless Subdivision, Ames, Iowa and deems it advisable to do so; WHEREAS,the Mortgagee has been requested to release the lien of said mortgage with respect to certain tracts dedicated to public use within said subdivision plat; NOW,THEREFORE,for good and valuable consideration: 1. CONSENT. The Mortgagee agrees and consents to the platting of the real property de- scribed in the attached subdivision plat to be known as Fourth Addition, Dauntless Subdivision, Ames, Iowa to which this Mortgagee's Consent to Platting. 2. PARTIAL RELEASE. The Mortgagee does hereby release the lien of said mortgage as to that certain real property situated in Story County,Iowa, described as follows: Lots C and D,Fourth Addition,Dauntless Subdivision,Ames,Iowa. This instrument constitutes a release of the lien of said mortgage only as to the real property described above and shall not affect the lien of said mortgage on the remaining real property described therein which shall remain in full force and effect. IN WITNESS WHEREOF, the Mortgagee has caused this instrument to be executed on its behalf on this 13 `"day of March,2000.
