RESOLUTION NO. 00-103
Approving the final subdivision plat of Fourth Addition,Dauntless
Subdivision,Ames,Iowa, accepting and dedicating to the pubic use rights of way and
easements, and accepting certain public improvements
Whereas the City Council has authority, as described in article III, section 38A of the Con-
stitution of the State of Iowa and in chapters 354 and 355 of the Code of Iowa (2000), to review and ap-
prove subdivision plats within the corporate limits;
Whereas there has been submitted to the City Council of the City of Ames, Iowa, a plat of
the real property hereinafter described and designated as "Fourth Addition, Dauntless Sudvivision,
Ames,Iowa" a replat of:
Outlots"Q,""R," "V," and"W'and the South 50 feet of Outlots "S" and"U" all in the
First Addition,Dauntless Subdivision,being a part of the City of Ames, and located in
the East '/Z of Section 7, Township 83 North, Range 24 West of the 5th P.M., Story
County,Iowa,more particularly described as:
Beginning at the Southeast Corner of Outlot "W' of said First Addition, Dauntless
Subdivision, an official plat; thence North 67' 49' 31" West along the South Line of
said Outlot"W' and along the South Line of Outlot"V," a distance of 2,717.18 feet to
the Southwest Corner of said Outlot "V"; thence North 00' 15' 36" East along the
West Line of said Outlot "V" and along the West Line of Outlot "U," a distance of
800.36 feet to a point on the West Line of said Outlot "U"; thence South 89' 44' 24"
East, a distance of 154.79 feet; thence along a curve concave Southerly an arc dis-
tance of 305.99 feet whose radius is 800.00 feet and whose chord bears South 78'46'
58" East, a distance of 304.13 feet; thence South 67' 49' 31" East, a distance of
785.13 feet to a point on the West Line of Outlot "R"; thence North 22" 10' 29" East
along the West Line of said Outlot"R," a distance of 347.09 feet to the Northwest Cor-
ner of said Outlot "R'; thence South 72' 05' 00" East along the North Line of said
Outlot"R," a distance of 239.45 feet to the Northeast Corner of said Outlot"R"; thence
North 17'55' 00"East along the West Line of Outlot"Q," a distance of 300.00 feet to
the Northwest Corner of said Outlot "Q'; thence South 72' 05' 00" East along the
North Line of said Outlot"Q," a distance of 324.48 feet to the Southeast Corner of Lot
21,First Addition,Dauntless Subdivision;thence North 79'21' 54"East, a distance of
66.31 feet to the Southwest Corner of Lot 22, First Addition, Dauntless Subdivision;
thence South 72' 05' 00"East along the North Line of said Outlot "Q," a distance of
239.75 feet to the Southeast Corner of said Lot 22; thence North 17' 55' 00" East
along the North Line of said Outlot"Q," a distance of 35.00 feet to the Southwest Cor-
ner of Lot 23, First Addition, Dauntless Subdivision; thence North 89' 53' 37" East
along the North Line of Outlot"Q," a distance of 350.00 feet to the Northeast Corner
of said Outlot"Q"; thence South 00' 06' 23" East along the East Line of said Outlot
"Q," a distance of 675.37 feet; thence South 150 16' 12" West along the East Line of
said Outlot"Q" and along the East Line of said Outlot"W," a distance of 207.43 feet;
thence South 01° 36' 45" West along the East Line of said Outlot "W," a distance of
1,000.45 feet to the Point of Beginning.
Whereas Terra Firma, L.P., an Iowa limited partnership; Everett W. Cochrane and
Marjorie L. Cochrane, husband and wife; Jensen Development Corporation,LTD, an Iowa corpora-
tion; and Erben A. Hunziker as Trustee of the Erben A. Hunziker Revocable Trust dated July 28,
1992, as sole owners of said real property, has caused to be executed and acknowledged an instrument
consenting to said plat;

Whereas said plat has been reviewed by the Planning and Housing Department and the
Planning and Zoning Commission and has been acted on as provided by law and complies with all re-
quirements of chapters 354 and 355 of the Code of Iowa and the platting ordinance of the City of Ames,
Iowa;
Whereas the City Council deems this resolution appropriate, necessary, and in the interests
of the citizens of the City of Ames and thereby to protect, preserve, and improve the rights, privileges,
property,peace, safety,health,welfare, comfort,and convenience of the City and its residents, all as pro-
vided in section 364.1 of the Code of Iowa(2000);
Now,THEREFORE,BE IT RESOLVED by the City Council of Ames,Iowa:
1. The City Council accepts and approves as an official subdivision plat to be known as"Fourth Addi-
tion, Dauntless Sudvivision, Ames, Iowa" a replat of Outlots "Q "R" "V and "W' and the
South 50 feet of Outlots"S" and"U" all in the First Addition,Dauntless Subdivision,being a part
of the City of Ames, and located in the East''/2 of Section 7,Township 83 North,Range 24 West of
the 5th P.M.,Story County,Iowa.
2. The City Council accepts and dedicates for street right-of-way purposes those certain tracts of land
designated on said plat and described as Lots A,B, C, and D, Fourth Addition,Dauntless Subdivi-
sion,Ames,Iowa, and to be known as Mortensen Road and Dickinson Avenue.
3. The City Council accepts for utility purposes all other land designated on said plat for easement pur-
poses.
4. In accordance with the certificate of the municipal engineer that the following public improve-
ments required for approval of the final plat of said subdivision have been satisfactorily completed
in accordance with approved construction plans, the City Council accepts as satisfactory and com-
plete: the water distribution system and the sanitary sewer system.
5. The Mayor and Clerk are authorized and directed to certify and affix to said plat a true copy of this
resolution in accordance with sections 354.8 of the Code of Iowa.
6. All other resolutions or parts of resolutions in conflict with this resolution are hereby repealed. If
any section,provision,or part of this resolution shall be adjudged invalid or unconstitutional, such
adjudication shall not affect the validity of the resolution or action of the City Council as a whole
or any section,provision, or part thereof not adjudged invalid or unconstitutional. This resolution
shall be in full force and effect from and after the date of its approval as provided by law.
APPROVAL BYMAYOR
The foregoing Resolution having been adopted this date by the City Council, I hereby

The City Council of Ames, Iowa, met in regular session in the council chambers, City
Hall, Ames,Iowa, at 7:00 P .M., on the 28thday of March , 2000,with the Mayor pre-
siding and the following Council Members present and absent:
Present: Cross, Goodhue, Hoffman, Quirmbach, Wirth
Absent: Campbh lI
Council Member Cross introduced the resolution and moved its adoption. Council
Member Hof fman seconded the motion to adopt. Upon consideration,the Mayor put the question
on the motion. The roll was called and the Council Members voted as follows:
Yes: Cross, Goodhue, Hoffman, Ouirmbach, Wirth
No: None AbsentWOOW: Camp ll
The Mayor declared the resolution adopted.
