HomeMy WebLinkAbout~Master - Vacation of public utility easements at 1606, 1610, and 1614 South Kellogg Avenue DO NOT WRITE IN THE SPACE ABOVE THIS LINE,RESERVED FOR RECORDER Prepared by:Judy K.Parks,City Attorney,515 Clark Avenue,Ames,IA 50010 Phone:515-239-5146 Return to:Ames City Clerk,P.O.Box 811,Ames,IA 50010 Phone:515-239-5105 RESOLUTION NO. 13-432 RESOLUTION APPROVING VACATION OF PUBLIC UTILITY EASEMENT AT 1606, 1610,AND 1614 SOUTH KELLOGG AVENUE FOR THE CITY OF AMES,IOWA WHEREAS, the City of Ames has a public utility easement on property owned by Cyclone Center, LLC, at 1606, 1610, and 1614 South Kellogg Avenue; and, WHEREAS,the property owner proposes to sell this property,however,it has been discovered that there is a public utility easement located under the existing building; and, WHEREAS,the property owner has requested that the easement be vacated to accommodate the sale of this property; and, WHEREAS,pursuant to Iowa Code Section 364.7,it is necessary to provide notice and public hearing regarding the proposal of the City to dispose of its interest in this real property; and, WHEREAS, following notice and public hearing, the City will determine if this proposal is appropriate. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AMES,IOWA, THAT: 1. Pursuant to Iowa Code Section 364.7,publication of notice regarding the proposed vacation of a public utility easement and establishing a public hearing date regarding the proposal has been made. 2. The public hearing regarding the disposition of the property is hereby closed. 3. The easement across the following described land is hereby vacated: General Public Utility Easement described as a 5-foot wide strip described as the East Five(5)Feet of the West 297.8 Feet of Lot 1 of the Southtown Subdivision Final Plat as recorded November 27, 1974, in Book 125,Page 672 which is also referenced on the Link Subdivision Final Plat recorded October 15, 2004.
