COUNCIL ACTION FORM
SUBJECT: SET THE DATE OF PUBLIC HEARING FOR FEBRUARY 14, 2006, TO
VACATE THE STORM SEWER EASEMENT ON LOT 9 IN DAUNTLESS
SUBDIVISION, 3RD ADDITION
BACKGROUND:
A Storm Sewer Easement was granted to the City with the Final Plat of Dauntless
Subdivision, 3rd Addition across Lot 9. The easement was over a storm sewer that
drained from Twain Circle across a portion of the lot to the larger public storm sewer
along South Dakota Avenue. This lot was included with a lot line adjustment made
through a Plat of Survey filed with Story County on December 20, 2005. The existing
storm sewer was in the center of the building area on the new lot and needed relocation
to facilitate development. A new storm sewer easement corresponding with the
relocated sewer is shown on the attached map and was recorded by the developer.
The Storm Sewer Easement to be vacated is described as follows:
"A.* ten-foot wide strip being five feet on each side of the following
described centerline:
Beginning at the Southeast corner of Lot 9, thence North 44031'42" West,
199.36 feet to Twain Circle and the Point of Ending, Third Addition,
Dauntless Subdivision, Ames, Story County, Iowa."
ALTERNATIVES:
1. Set the date of public hearing for February 14, 2006, to vacate the storm sewer
easement on Lot 9 in Dauntless Subdivision, 3rd Addition.
2. Retain easement as granted.
MANAGER'S RECOMMENDED ACTION:
Since the "existing" storm sewer easement has been replaced with the "proposed"
easement, it is the recommendation of the City Manager that the City Council adopt
Alternative No. 1, thereby setting the date of public hearing for February 14, 2006, to
vacate the storm sewer easement on Lot 9 in Dauntless Subdivision, 3rd Addition.
