HomeMy WebLinkAboutA004 - Resolution No. 02-210 adopted April 9, 2002 t RESOLUTION NO. 02-210 RESOLUTION DIVIDING SPECIAL ASSESSMENTS MADE AGAINST LOT 2 OF PETE COOPER'S SUBDIVISION BETWEEN TWO PARCELS FORMED BY THE AUDITOR'S PLAT OF SAID LOT 2 WHEREAS,the Ames City Council previously has levied special assessment#71,tract#25580 for the Southeast 5th Street Improvement against Lot 2 of Pete Cooper's Subdivision, Ames, Iowa; and, WHEREAS,the unpaid amount for said assessment with respect to the said lot remaining after the March 2002 payment is$4,095.42; and,. WHEREAS, Lot 2 of Pete Cooper's Subdivision has been platted into three parcels (Lot 1 and Outlots A and B)by an Auditor's Plat filed for record as Instrument No.00-10059 in the office of the Story County Recorder; and, WHEREAS,a request has been made to the City Council by the County Auditor to divide using the authority granted in Section 384.16 Code of Iowa,the aforesaid unpaid amount of said assessment between Lot 1 of the said Auditor's Plat and Outlot A of the said Auditor's Plat; and, WHEREAS,the lien in favor of the City arising under paragraph 5 of Section 364.65 Code of Iowa against the said real estate for the unpaid amount of the assessment shall not be affected by the proposed division; NOW,THEREFORE,IT IS HEREBY RESOLVED, by the City Council of the City of Ames, Iowa as follows: 1. Special Assessment#71,Tract#25580,in the unpaid amount of$4,095.42 is hereby divided among lots as follows: a) To Outlot B of the Auditor's Plat of Lot 2, Pete Cooper's Subdivision, City of Ames, Story County, Iowa(tax parcel No. 09 12 251 200), the amount of$890.31; b) To Outlot A of the Auditor's Plat of Lot 2, Pete Cooper's Subdivision, City of Ames, Story County, Iowa, (tax parcel#09 12 201 200), the amount of$3,205.11. 2. The City Clerk is hereby authorized and directed to certify the aforesaid separate special assessments to the Treasurer of Story County, Iowa, for collection over the remaining life of the original assessment in the same manner as though levied originally upon the six separate tracts of land. A copy of this resolution certified by the City Clerk as a true copy is to be filed with the Story County Recorder, and the Story County Auditor, as well as the Story County Treasurer, to show the division of the assessment.
