COUNCIL ACTION FORM
SUBJECT: RESOLUTION APPROVING THE AUDITOR'S PLAT OF LOT 2, PETE
COOPER SUBDIVISION.
ACTION FORM SUMMARY: The Story County Auditor's Office has directed at an
Auditor's Plat be prepared for several parcels of property that have been created fro, an
original platted lot that was previously described as Lot 2, Pete Cooper Subdivision.
Staff is recommending that this Auditor's Plat be approved.
BACKGROUND:
Section 354.13 provides that the County Auditor can demand that a Plat of Survey or
subdivision plat be prepared when a property description is not clear or a land division has
occurred and has not been approved according to State statute.
A lot previously described as Lot 2 of Pete Cooper Subdivision has been divided twice in
the past without the approval-of these divisions by the City Council. These divisions have
resulted in a total of three parcels being created. The Auditor has now ordered that an
Auditor's Plat be prepared.
These parcels are located in the eastern portion of the City South of Lincoln Way
immediately east of Freel Drive.
Only one of the parcels has frontage on public right-of-way. The other two parcels have
no frontage on a public right-of-way and thus are not buildable parcels. All of the lots are
zoned G-1 General Industrial.
ANALYSIS:
The staff has reviewed the Auditor's Plat for Lot 2, Pete Cooper Subdivision. The
proposed Lot 1 of this Auditor's Plat has frontage on Lincoln Way and thus meets the
requirements of the City's regulations. The proposed Outlot A and Outlot B do not have
frontage on a public street and thus do not meet the frontage requirement of the
subdivision regulations.
Staff has directed that these two outlots be designated as unbuildable. No public
improvements are required as part of this subdivision. With this restriction, it is staffs belief
that both Outlot A and Outlot B meet the requirements of the regulations.

In all other respects, the Auditor's Plat meets the requirements of the City. Staff is
recommending that this plat be approved. (A copy,of the Auditor's Plat is attached.)
ALTERNATIVES:
1. The City Council can approve the Auditor's Plat of Lot 2, Pete Cooper Subdivision.
2. The City Council can deny approval of the Auditor's Plat of Lot 2, Pete Cooper
Subdivision.
13. The City Council can approve the Auditor's Plat of Lot 2, Pete Cooper Subdivision
with modifications.
MANAGER'S RECOMMENDED ACTION:
it is the recommendation of the City Manager that the City Council adopt Alternative #1.
This action will approve the Auditor's Plat of Lot 2, Pete Cooper Subdivision. With the
restriction that Outlot A and Outlot B are unbuildable, staff believes that this plat meets the
regulations of the City. This land division has already occurred and there is little the City
can do to change the division other than to restrict the lots from future building where no
frontage exists.
