(COUNTRY GABLES 2ND, 3RD, 4TH SUBDIVISIONS)
WHEREAS , construction of sidewalks in the Country
Gables 2nd, 3rd and 4th Subdivisions by the subdivider is .a
condition for approval by the City of Ames of the plat of said
subdivision; and,
Whereas, it is desired that in accordance with cus-
tomary building practice the construction of a sidewalk per-
taining to a lot in said subdivision not be done until comple-
tion of a principal building on the lot so as to avoid destruc-
tion of the sidewalk by passage of heavy construction equipment
and vehicles;
NOW THEREFORE, BE IT KNOWN:
That Frank Schill , personally and as principal; and,.
Frank Schill & Sons , Inc. ; as corporate surety., are hereby
held and firmly bound as obligors unto the obligee City of
Ames , Iowa in the penal sum of ($3 ,230 . 00) for the payment of
which sum, well and truly to be made, we do jointly and
severally bind outselves, our heirs, executors, successors
and assigns hereby .
The condition of the above obligation is such that
if all sidewalks required to be constructed as a condition for
approval of the plat of the aforesaid subdivisions shall be
properly constructed in accordance with the standards and
specifications of the City of Ames Department of Public Works,
with relation to each and every lot as a principal building
is completed on said lot, then this obligation to be void,
otherwise to remain in full force and effect.
