HomeMy WebLinkAboutA036 - Guaranty and Assurance for site Improvements, Stonehaven Elderly Housing Project GUARANTY AND ASSURANCE FOR SITE IMPROVE- MENTS, STONEHAVEN ELDERLY HOUSING PROJECT, COOPER'S SECOND ADDITION, AMES, IOWA In consideration of financial assistance given or to be given to development of an elderly housing project in the City of Ames, Iowa said project called Stonehaven, and to be constructed on land to be platted as Cooper's Second Addition to the City of Ames, Iowa, the said City of Ames, Iowa, does hereby irrevocably and unconditionally guarantee to the United States Department of Housing and Urban Development that the following off-site improvements shall be installed by the developers of the said elderly housing project prior to project occupancy being per- mitted by the City of Ames, To Wit: a. Install a 4 ft. wide, 4 inch thick P.C.C. sidewalk as shown on Sheet Al of Stonehaven plans, per City of Ames specifications. Sidewalk to be along the Stonehaven Drive right of way from the northeast corner of Stonehaven property, north to South 4th Street then westerly along South 4th to the intersection with South 3rd_ Street. Provide walk to street crossing on 3rd. Distance is approximately 520 LF. b. Install Stonehaven Drive and Squaw Creek Drive per City of Ames specifications. Street to be a 31 ft. back to back 7 inch thick asphalt street with 6 inch by 30 inch concrete curb and gutter along each side. This street improvement is to include the con- crete intersection required to adjoin to South 4th Street. Said street will be in the proposed right of way and extend south from 4th Street, turn west and extend to the west property line, a distance of approximately 756 LF. C. (1) Install an 8 inch PVC water main with fire hydrant and re- quired gate valve, per City of Ames specifications, from an exist- ing 8" main (located in Stonehaven Drive right of way) south and west along the south property line in Squaw Creek Drive right of way to the west property line, an estimated distance of 485 LF. (2) . Install an 8 inch sanitary sewer with manholes, per City of Ames specifications from the intersection with the existing sani- tary sewer located in the Stonehaven Drive right of way east of the site, extending west in the Squaw Creek Drive right of way along the south property line to the west property line, an estimated distance of 500 LF. (3) Install underground electrical service per City of Ames Speci- fications and City of Ames Electrical Department requirements, from an existing pole at the intersection of South 3rd Street and south 4th Street, under South 4th Street, and across private property south to the Stonehaven property line (approximately 300 LF.) . Also provide required conduit under Squaw Creek Drive as required by the Electrical Department for future use (approximately 60 LF.) . (4) Gas service is to be installed in the right of way from an existing gas main to the site by the utility company, Iowa Electric Light and Power at no cost to the project or the Seller. (5) Install telephone service to the property line as shown on Sheet Al, per City of Ames specification and the serving utilities' requirements. d. Install a storm sewer extension at the outflow of the existing double 42 inch storm sewers located adjacent to South 4th Street near the Stonehaven Drive right of way. This storm sewer extension is to be installed per City of Ames specifications. The storm sewer consists of a cast-in-place reinforced concrete collection manhole with approximately 140 LF of 54 inch diameter aluminized corrugated steel pipe by way of a cast-in-place reinforced concrete headwall . The 102 inch arched pipe extends approximately 210 LF south along the project property line, under the street through the right of way and then daylights the outflow into an existing drain- age way. In furtherance of the foregoing the City of Ames has secured the attached covenant of the developers and owners of the project that they shall not seek or permit occupancy of the project prior to completion of the said improvements to the satisfaction of the city of Ames, Iowa; and, the city of Ames has received an irrevocable letter of credit from the Firstar Bank of Ames in the Amount of $171,000 to pay up to said amount on demand of the City of Ames if said improvements are not complete to the specification and satisfaction of the City of Ames, Iowa before May 1, 1992.
