PERMANENT STORM SEWER AND OVERLAND FLOW CHANNEL EASEMENT
KNOW ALL MEN BY THESE PRESENTS:
That (1/we), E. Kent Cooper and Joan E. Cooper (do/does) hereby grant unto the City of
Ames, Iowa, a municipal corporation its successors and assigns, the perpetual right to
enter upon the land described and the perpetual right to construct, reconstruct, clean up,
operate, maintain, and cover over and repair a permanent storm sewer and overland flow
channel easement upon, under, and across the land described as follows:
DESCRIPTION:
An irregularly shaped permanent storm sewer and overland flow channel easement over
and across a portion of Lot 3 in Coopers Second Subdivision is more accurately
described as: Beginning at the northeast corner of Lot 3 in Coopers Second Subdivision,
an official plat, Ames, Story County, Iowa; thence, S06013' 32" west along the easterly
line of said Lot 3, a distance of 43.11 feet; thence continuing southerly along the easterly
line of said Lot 3 and along a 948.19 feet radius curve concave westerly, a distance of
125.63 feet, said curve having a chord bearing of S10°01'15" west and a chord length of
125.54 feet to the southeast corner of said Lot 3; thence, N7614' 43" west along the
southerly line of said Lot 3, a distance of 40 feet; thence northerly along a curve 40 feet
west of and normally distant to the east line of said Lot 3, a distance of 81.11 feet, said
curve having a chord bearing of N11 °15' 40" east and a chord length of 81.08 feet ;
thence, S76°00' 00" east, a distance of 12.80 feet; thence, N14°00' 00" east, a distance
of 59.50 feet; thence, N76°00'00" west, a distance of 20.07 feet; thence, N06013'32" east
along a line parallel with and 40 feet west of the easterly line of said Lot 3, a distance of
25.49 feet to the northerly line of said Lot 3; thence easterly along the northerly line of
said Lot 3 and along a 654.68 feet radius curve concave northerly, a distance of 40.12
feet, said curve having a chord bearing of S79°23'32" east and a chord length of 40.12
feet to the point of beginning.
See attached plat made a part hereof.
The foregoing rights are granted upon the express condition that the City of Ames, Iowa,
will assume all liability for all damages to the above described property caused by the
City's failure to use due care in its exercise of the rights granted.
Further, the grantor shall save the City harmless from any property damage caused by
overland flow of storm water across said easement and agrees to replace all paving,
landscaping material, sod, and all other items removed during repair of storm sewer or
overland flow channel at the grantor's expense.
