HomeMy WebLinkAbout~Master - Proposal to lease space for temporary relocation of Ames Public Library Page 2 RESOLUTION NO. 12-496 To fix a date for a public hearing on a lease agreement in the principal amount of $414,300 for twenty-one months, with the option of extending the lease terns for up to twelve additional months at the lease rate of$14,300 per month. WHEREAS, the City of Ames (the "City"), in Story County, State of Iowa, did heretofore undertake the Library Renovation and Expansion Project; and WHEREAS, the City proposes to enter into a lease agreement (the "Lease Agreement") in the principal amount of $414,300 for twenty-one months, with the option of extending the lease for up to twelve additional months at the lease rate of$14,300 per month, pursuant to the provisions of Sections 364.4 and 384.25 of the Code of Iowa for the purpose of paying the cost of rented space for the temporary relocation of library services and operations during the construction of the Library Renovation and Expansion Project, and it is necessary to fix a date of meeting of the City Council at which it is proposed to take action to enter into the Lease Agreement and to give notice thereof as required by such law; NOW, THEREFORE, Be It Resolved by the City Council of the City of Ames, Iowa, as follows: Section 1. The City Council shall meet on the 25nd day of September, 2012, at the Ames City Hall Council Chambers, Ames, Iowa, at seven o'clock p.m., at which time and place a hearing will be held and proceedings will be instituted and action taken to enter into the Lease Agreement. Section 2. The City Clerk is hereby directed to give notice of the proposed action on the Lease Agreement setting forth the amount and purpose thereof, the time when and place where the said meeting will be held, by publication at least once, and not less than four nor more than twenty days before the meeting, in a legal newspaper which has a general circulation in the City. The notice shall be in substantially the following form: Page 3 NOTICE OF PROPOSED ACTION TO INSTITUTE PROCEEDINGS TO ENTER INTO A 21-MONTH LEASE AGREEMENT IN THE PRINCIPAL AMOUNT OF $413,300, WITH THE OPTION OF EXTENDING THE LEASE TERM FOR UP TO 12 ADDITIONAL MONTHS AT THE LEASE RATE OF $14,300 PER MONTH, FOR TEMPORARY RELOCATION OF LIBRARY OPERATIONS (LIBRARY RENOVATION AND EXPANSION PROJECT) The City Council of the City of Ames, Iowa, will meet on the 25th day of September, 2012, at the Council Chambers, Ames, Iowa, at seven o'clock p.m. for the purpose of instituting proceedings and taking action to enter into a lease agreement (the "Lease Agreement") in the principal amount of $414,300, with the option of extending the lease term for up to twelve additional months at the lease rate of$14,300 per month, for the purpose of paying the cost of rented space for the temporary location of library services and operations during the construction of the Library Renovation and Expansion Project. The Lease Agreement will be payable from the general fund. The Lease Agreement is proposed to be entered into pursuant to authority contained in Sections 364.4 and 384.25 of the Code of Iowa. At such time and place, oral or written objections may be filed or made to the proposal to enter into the Lease Agreement. After receiving objections, the City Council may determine to enter into the Lease Agreement, in which case, the decision will be final unless appealed to the District Court within fifteen (15) days thereafter.
