UTILITY EASEMENT GLORIA A. 0440, Recorder er...... w...�.................. , .a.oun KNOW ALL MEN BY THESE PRESENTS: That Marjo, Inc. , a corporation organized and existing under the laws of the State of Iowa and having its principal place of business in Story County, Iowa, in consideration of One Dollar and other good and valuable consideration, does hereby grant unto the City of Ames, Iowa, a municipal corporation, its successors and assigns, the perpetual right to construct, reconstruct, maintain and use electric lines, consisting of poles, wires, cables, conduits, fixtures, anchors and similar equipment, including the right to trim or remove trees within such area where necessary to secure a clearance of four feet from the wires or poles, together with the right to extend to telephone, telegraph, electric or power companies, the right to use separately or jointly with the City of Ames, Iowa, the areas included in this easement for the purposes above enumerated, over, upon, across or under the following described real estate, situated in the County of Story, State of Iowa, to-wit: West 5 feet of Lots 5, 7, 8, 9, 10, 11, 12, 13 and 16; East 5 feet of Lots 1, 5, 6, 14 and 15; East 10 feet of Lot 18; , North 5 feet of Lots 5, 6 and 7; North 10 feet of Lots 1, 2 and 3; South 5 feet of Lots 9, 11, 13 and 14; South 10 feet of Lots 16, 17 and 18; All in Cochrane's First Addition to the City of Ames, Iowa. d Q The foregoing rights are granted upon the express condition that the City of Ames, Iowa, will assume responsibility for all damage to the above described property caused by the City's failure to use due care _o in,the exercise of .its granted right.
