SUBJECT: Release of Easement, Camelot Subdivision
At its December 15 meeting the Council adopted a resolution to release
an easement in Camelot subdivision to facilitate the construction of a
proposed building. Attached is the form of resolution for the Mayor to
sign. I do not believe any other instrument should be necessary. If
the land owner wishes to do so he could have the resolution recorded to
document the release and abandonment by the City.
A condition precedent to the abndonment is the issuance of the building
permits. As a condition subsequent the release is void if the building
is not constructed in twenty-four months after the permit is issued.
These conditions are consistent with the premise for release. Many more
buildings are planned than built. If nothing is built as presently
planned, the continuance of the easement could prove useful for some
other plan some other time.
