HomeMy WebLinkAbout~Master - Five-Year Lease for Parking Lot P DO NOT WRITE IN THE SPACE ABOVE THIS LINE,RESERVED FOR RECORDER Prepared by:Douglas R.Marek,Ames City Attorney,515 Clark Avenue,Ames,IA 50010 Phone:515-239-5146 Return to:Ames City Clerk,P.O.Box 811,Ames,IA 50010 Phone:515-239-5105 RESOLUTION NO. 12-405 RESOLUTION APPROVING NEW LEASE AGREEMENT WITH YOUTH& SHELTER SERVICES FOR MUNICIPAL PARKING LOT P FOR THE CITY OF AMES WHEREAS, on May 22, 2012, the Council discussed the request from Youth& Shelter Services (YSS) regarding its desire to renew the parking lease agreement for Municipal Lot P at 308 5th Street; and, WHEREAS, Municipal Lot P was leased to YSS as part of the Development Agreement for the renovation of the old City Hall at 420 Kellogg Avenue beginning in 1995; and, WHEREAS, S ection 8 of the Development Agreement specified terms of the parking lease related to the use and maintenance of the lot, and YSS was responsible for all routine maintenance, such as cleaning, snow removal, and minor crack sealing or filling of potholes, etc., and the City was responsible for any major resurfacing or reconstruction; and, WHEREAS, the Agreement became active at the tune the deed was transferred to YSS, which was April 8, 1997, and this was to be used as the start date for the 15-year lease term; and, WHEREAS, since the current Lease Agreement expired on April 8, 2012, a new Agreement is required should the City Council decide to offer the parking spaces to YSS for another five-year period; and, WHEREAS, in order to approve a new lease, the Council should determine the terms of the new contract; and, WHEREAS, the only modifications to the existing Agreement language that will be needed are related to the Council's ultimate decision regarding an appropriate monthly rental fee per space and determination of who should be responsible for routine maintenance of the lot. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Ames, Iowa, that the new Lease Agreement with Youth & Shelter Services for exclusive use of Municipal Parking Lot P expiring June 30, 2017, at a rate of $20/space/month, and maintaining all other provisions of the current Agreement is hereby approved.
