COUNCIL ACTION FORM
SUBJECT: ABANDONING EAST 6' OF A UTILITY EASEMENT ACROSS THE
WEST 10' OF LOT 18 BROOKVIEW PLACE SUBDIVISION FIRST ADDITION
BACKGROUND:
The owner of this lot reports that his house occupies some of this utility easement.
The owner has requested that the City abandon the west 6' of the easement to correct
the problem. Staff has contacted electric, telephone, and cable T.V. utilities and they do
not object to the reduction in width.
In order to make sure this does not occur in the future, staff will check plats more
closely to make sure the building set backs to the lot line do not conflict with any
existing easements on the property.
ALTERNATIVES:
1. Grant the request and abandon the west 6' of the utility easement.
2. Reject the request.
MANAGER'S RECOMMENDED ACTION:
It is the recommendation of the City Manager that the City Council abandon the east 6'
of the utility easement described as the west 10' of Lot 18 Brookview Place Subdivision
First Addition, Ames, Story County, Iowa.

Dear Mr. Byg:
I am writing to request that the easement on the west side of our property at 5306
Maryland St. be changed from 10 ft. to 4 ft. It appears to us that the utilities are actually on
the property beside ours and not on ours. Our house is currently on some of that 10 ft.
easement and was approved by the building inspector. Thank you for your help with this
matter.
