Dear Mr. Randall :
At your request I have examined the abstract of title to the
following described real estate, to-wit :
Outlot A, Aspen Business Park Subdivision, First Addition
to Ames, Iowa;
as continued from the Root of Title down to and including the 27th
day of March, 2000 at 8 : 00 A.M. as last certified by Iowa Title
Company.
From this abstract I find that as of the date last mentioned,
merchantable title to said real estate was vested in SCOTT E.
RANDALL and JANE S . RANDALL, husband and wife, subject to the
following comments and objections :
1 . Entry 28 discloses that said real estate is subject to
certain RESTRICTIVE COVENANTS running with the land and binding
upon the owner thereof until January 1, 2014 , which in substance
limit the use of said real estate for commercial purposes and set
minimum standards for its development .
2 . Entry 30 discloses that a perpetual EASEMENT has been
granted to the City of Ames, Iowa, over the east 150 feet of the
north 5 feet and the east 320 feet of the south 5 feet and the
easterly 10 feet of said real estate for general utility water
mains and storm sewers .
3 . Entry 33 discloses that a perpetual EASEMENT has been
granted to the City of Ames, Iowa, over the north 20 feet of the
east 20 feet of said real estate for sign purposes .
4 . Entry 40 discloses that said real estate is subject to
ZONING ORDINANCE No. 2751 of the City of Ames, Iowa, which

ordinance classifies it as a G-C District (General Commercial) , and
restricts its use and occupancy accordingly. For further
particulars you are referred to the ordinance .
5 . Entry 41 discloses that the regular fiscal year 1998-1999
TAXES on said real estate, payable in 1999-2000 , for the first
installment in the amount of $79 . 00 is paid and the second
installment in the amount $79 . 00 is unpaid, but not delinquent .
6 . A MORTGAGE is shown in favor of F & M BANK - IOWA to
secure an indebtedness . Said Mortgage is dated March 24 , 2000, and
was filed on March 27 , 2000 , in the Story County Recorder' s office
as Instrument No. 00-03033 , records of Story County.
7 . An ASSIGNMENT OF RENTS is shown to dated March 24 , 2000,
and recorded March 27 , 2000 , as Instrument No . 00-03034 , records of
Story County, Iowa .
8 . The UCC-2 Financing Statement is dated March 24 , 2000 ,
and recorded March 27, 2000, as Instrument No. 00-03035, records of
Story County, Iowa.
CAUTION
Since the following cannot be determined by examination of the
abstract, your attention is called to the fact that you are
required to take notice of the rights of all persons in possession
of the real estate other than the titleholders of record; any facts
that would be disclosed by a survey; the right to file mechanic ' s
liens against the premises for labor or materials furnished in
connection with improvements thereon, within ninety days from the
furnishing of the last item; and any restrictions as to building,
occupancy, or usage contained in applicable zoning or other city
ordinances .
