COUNCIL ACTION FORM
SUBJECT: PARTIAL VACATION OF UTILITY EASEMENT FOR VICKI
SETTERBERG, 5428 NORRIS STREET - OWNER OF LOT 65 BENTWOOD SUB-
DIVISION FIRST ADDITION.
BACKGROUND:
The west 10' of Lot 65 Bentwood Subdivision First Addition is designated as a utility
easement.
The property owner has requested a building permit for a detached garage and would
like to use a sideyard setback of 6'. This means that the garage would be protruding
into the easement 4'.
Staff has reviewed the space needs of the various utilities occupying the easement and
has determined that the easement can be narrowed to 6' and still adequately serve the
utilities.
ALTERNATIVES:
1 . Reject the request to vacate the east 4' of the 10' utility easement along the west
side of Lot 65 Bentwood Subdivision First Addition utility easement.
2. Approve the request and vacate the east 4' of the 10' utility easement along the
west side of Lot 65 Bentwood Subdivision First Addition.
MANAGER'S RECOMMENDED ACTION:
It is the recommendation of the City Manager that the City Council adopt alternative
number two thereby approving the request and vacating the east 4' of the 10' utility
easement along the west side of Lot 65 Bentwood Subdivision First Addition.
