RESOLUTION NO. 12-031
RESOLUTION APPROVING THE PREVIOUSLY PROPOSED
CONVEYANCE TO THE DEPARTMENT OF AGRICULTURE OF THE
CITY'S RIGHT, TITLE AND INTEREST IN CERTAIN LAND
CONSISTING OF 43.4 ACRES, MORE OR LESS, LOCATED
GENERALLY WEST AND NORTH OF THE NATIONAL ANIMAL
DISEASE CENTER IN STORY COUNTY.
BE IT RESOLVED, by the City Council for the City of Ames, Iowa:
1. The City Council has authority, as described in article III, section 38A of the
Constitution of the State of Iowa and in section 364.7 of the Code of Iowa (2011), to dispose of
interests in real property.
2. The City of Ames owns certain real property legally described as follows:
The northeast 1/4 of the southeast 1/4, Section 25, Township 84 North,
Range 24 West of the 51h P.M., Story County, Iowa, and Parcel "A" of the
northwest 1/4, Section 25, Township 84 North, Range 24 West of the
5'P.M., Story County, Iowa, as shown on the "Plat of Survey" filed in the
office of the Recorder of Story County, Iowa, on May 30, 2000, as Inst.
No. 00-05678, Slide 70, Page 3.
3. The United States of America, acting by and through the Agricultural Research
Service, Department of Agriculture, has offered to acquire this property in exchange for the real
property identified with the Story County Assessor's Office land records as Parcel Ids.
09-01-100-020 and 09-01-200-010, totaling 44.31 acres, more or less, pursuant to the terms of an
agreement dated January 17, 2012.
4. On the 13t' of December, 2011, the City Council previously approved Resolution
No. 11-562 proposing the disposal of said real property, setting a public hearing thereon, and
authorizing the publication of notice.
5. On the 241'' day of January, 2012, the City Council held a public hearing to
consider the proposal to dispose of said real estate and to receive public comment.
6. Having now fully complied with all of the formalities required by law for the sale
of municipally owned real property, the City Council now hereby approves the proposal to
dispose of the City's interest in said real property.
7. The Mayor is hereby authorized and directed to execute a Quit Claim Deed with
respect to the above described land for and on behalf of the City of Ames, Iowa, and the City
Clerk shall attest thereto.
