Title to the property is currently in Robert O. Buck and Anne K. Buck, husband and wife. There are no liens or encumbrances upon the property. There are various municipal utility easements. All of the real estate in Lot 1, The Green Sixth Addition to Ames, Iowa, is within the administrative plat for Arbor on the Green, a subdivision to Ames, Iowa. Mr. and Mrs. Buck have both informed me that they intend to sell and convey this real estate to Buck Construction Company, Inc., sometime in the first week of Janu- ary, 1994. When they execute and deliver a deed to the real estate to Buck Construction Company, Inc.,.merchantable title, free from lien or encumbrance, will reside in Buck Construction Company, Inc. It is my opinion that title to the real estate in the proposed subdivision to be called Arbor on the Green will be in Buck Construction Company, Inc., at the time the final plat for the proposed subdivision is before the City Council for action.
