RESOLUTION APPROVING REMOVAL OF 2008 REQUIREMENT TO SEAL-COAT
EXISTING PARKING AREAS AT HUNZIKER YOUTH SPORTS COMPLEX
FOR THE CITY OF AMES,IOWA
WHEREAS,on October 25,2011,the City Council referred a letter from the Hunziker Youth
Sports Complex Board of Directors requesting permission to construct additional gravel parking
areas at the Hunziker Youth Sports Complex(HYSC); and,
WHEREAS,this facility is managed by a non-profit organization that operates youth soccer,
baseball, and softball programs, and is located on City-owned land that was the site of the former
Water Pollution Control facility; and,
WHEREAS, permission to utilize this land was granted by the City in November 1994 in
accordance with a 30-year lease,and as owners of the property,the City retains the authority to grant
permission for the HYSC to make any physical modifications to the property; and,
WHEREAS, since the City has historically held its own property to the same standards as
privately owned property,the HYSC originally was required to pave its parking lots with asphalt or
concrete; and,
WHEREAS, HYSC representatives emphasized that this type of expense takes away funds
that could be used to improve playing fields and concession/restroom facilities; and,
WHEREAS,therefore,the HYSC was advised to seek a variance to the paving requirement
before the City's Zoning Board of Adjustment(ZBA),and although the ZBA denied the request for
the variance to the paving requirements of the parking lots, it granted three extensions totaling 13
years to allow the HYSC to phase in the hard-surfacing improvements through 2008; and,
WHEREAS, in September 2008, knowing that the time extension was about to elapse
without the possibility that the hard surfacing would be accomplished, the Council passed a
resolution formally exempting the HYSC from parking lot paving requirements and accepting seal-
coating for the off-street parking lots on the City property; and,
WHEREAS, even with the 2008 resolution in place to exempt the HYSC from the hard
surface parking requirements, as owner of the property, the City Council retains its authority to
determine which, if any, alterations can be made to this City-owned property, therefore, formal
action by the City regarding this request is appropriate.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Ames, Iowa,
that the request from the Hunziker Youth Sports Complex to remove the seal-coating requirement
adopted in 2008 for the existing parking areas at the site is hereby approved.
