Acceptance of the paving and release of the LOC are scheduled for City Council on November 18, 2003. However, the City Clerk informed me this morning that the letter of credit includes sidewalk, which has not been completed. Sidewalks are typically covered under a separate agreement that does not require bonding. The certification and release may remain on the agenda if this agreement is filed with the City Clerk before noon on Friday, November 14,_2003. Please contact John Klaus if you need an example agreement. Thanks, John AAAAAAAAAAAAAAAAAAAAAAAAAAAAAAAAAAAAAAAAAAAAAAAAAAAA John C. Joiner, P.E. As you may be aware, TPB signed an amended development agreement with the City of Ames whereby TPB agreed to pay for the last lift of asphalt on British Columbia Ave. That has now been completed and TPB would like a partial release from the City of Ames for the letter of credit TPB provided the City for this project. Would you please confirm that the project has been completed and that TPB will be released from this portion of the project? Thank you. Chip Baltimore (515)432-1355
