I, David W. Benson,the undersigned, state:
1. I am an attorney licensed to practice in the State of Iowa and my principal place
of business is located at 1416 Buckeye Avenue, Ames, IA 50010-8070 (Telephone:515-233-
3000).
2. Pursuant to the subdivision ordinance of the City of Ames, Iowa, I have
examined the abstract of title to the real property described in the attached plat to be known as
shown on exhibit"A", attached hereto.
3. Based on such examination, I find that fee simple title to said real property is
vested in (a) Ford Street Development Co., L.C., an Iowa Limited Liability Company(as to Lot 1,
Ames Community Development Park, Second Addition to Ames, Story County, Iowa); and (b)
Roger D. Pritchard and Judi K. Pritchard, husband and wife (as to Parcel "A" of Lot 5, Ames
Community Industrial Park Subdivision, Ames, Iowa, as shown on the "Plat of Survey" filed in
the office of the Recorder of Story County, Iowa, on the 9th day of June, 1993, and recorded in
Book 11 at Page 187.
4. Based on such examination, I find that said real property being platted is subject
to; (a) the terms of that certain "Development Agreement" executed by the City of Ames, Iowa,
and Ford Street Development Co., L.C., dated August 26, 1997, and filed in the office of the
Recorder of Story County, Iowa, on September 15, 1997, and recorded as Instrument No. 97-
09890; (b) the terms of those certain "Restrictive Covenants" executed by Ford Street
Development Co., L.C., as part of the subdivision plat of real estate known as "Ames Communit},
Development Park, Second Addition, Ames, Story County, Iowa" and filed in the office of the
Recorder of Story County, Iowa, on June 26, 1998, and recorded as part of Instrument No. 98-
08673, (c) the terms of those certain "Restrictive Covenants" executed by Ford Street
Development Partnership, as part of the subdivision plat of real estate known as "Ames
Community Industrial Park, Subdivision, Ames, Story County, Iowa" and filed in the office of the
Recorder of Story County, Iowa, on October 6, 1992, and recorded in Book 290 at Page 335; and
(d)that mortgage granted by Roger D. Pritchard and Judi K. Pritchard, husband and wife,to First
National Bank, Ames, Iowa, filed in the office of the Recorder of Story County, Iowa, on Max,
19, 1994,and recorded as Instrument Number 94-05713.
