HomeMy WebLinkAbout~Master - Extension of Agreement for legal services regarding Clean Air Act Regulatory Compliance RESOLUTION NO. 11-512 RESOLUTION AUTHORIZING EXTENSION OF AGREEMENT WITH RITTS LAW GROUP FOR LEGAL SERVICES IN CONNECTION WITH CLEAN AIR ACT REGULATORY COMPLIANCE FOR THE CITY OF AMES,IOWA WHEREAS, in September 2009, the City Council approved an engagement and retainer agreement with Ritts Law Group of Alexandria, Virginia, in an initial amount not to exceed $100,000 for legal services related to regulatory compliance issues under the Clean Air Act; and, WHEREAS,in September 2010,the City Council approved an extension of the engagement with Ritts Law Group for an additional amount not to exceed$50,000; and, WHEREAS, on March 1,2011,the Council approved another extension of the engagement with the Ritts law Group for an additional amount not to exceed$50,000; and, WHEREAS, most recently, the Ritts Law Group has provided legal and engineering assistance to the City in connection with administrative and judicial appeals of the Environmental Protection Agency's Cross-State Air Pollution Rule; and, WHEREAS, it is anticipated that the need for these specialized legal services will continue until the pending appeals and other regulatory issues are resolved; and, WHEREAS, since its engagement with Ritts Law Group in 2009, the City has expended a total of$194,060; and, WHEREAS funding is available from the Electric Fund balance. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Ames, Iowa, that an extension of the agreement with Ritts Law Group in an amount not to exceed $50,000 for additional legal services in connection with Clean Air Act regulatory compliance is hereby approved.
