SUBJECT:
A Resolution to Approve a Release of Liens on Lot 5 of the Ames
Community Industrial Park Subdivision.
ACTION FORM SUMMARYs This is a request from the purchasers of Lot 5 of
the Ames Community Industrial Park Subdivision to have the City of Ames
execute a Release of Liens on said property.
Staff is recommending approval with the condition of proof of payment of
any liens.
BACKGROUND:
The purchasers of the recently created Lot 5 of the Ames Community
Industrial Park Subdivision have asked the City to execute a certificate to
the effect that liens against that property are released. With the condition
that the assessments against that property have been paid or are in the
process of being paid. (See attached letter) . The certificate will not be
signed until verification of payment is received from the City of Ames
Finance Department.
It is staff's recommendation that the Mayor should be authorized to execute
the certificate on behalf of the City as requested, with the condition that
payment has been received.
ALTERNATIVES:
1. The City Council can approve the resolution to execute a Release of
Liens Certificate once payment has been received for Lot 5 of the
Ames Community Industrial Park Subdivision.
2. The City Council can deny approval of the resolution to execute a
Release of Liens Certificate once payment has been received for Lot 5
of the Ames Community Industrial Park Subdivision.
MANAGER'S RECOMMENDED ACTION:
It is the recommendation of the City Manager that the City Council adopt
Alternative #1. This will allow further development in the Tax Increment
Finance District.

WARRANTY DEED - JOINT TENANCY
KNOW ALL PERSONS BY THIS DEED: That FORD STREET DEVELOPMENT
COMPANY, an Iowa General Partnership, in consideration of the sum
of one (1) Dollar and other good and valuable consideration in hand
paid do hereby Convey unto WILLIAM H. BERGAN and KAREN M. BERGAN,
husband and wife, as Joint Tenants with Full Rights of
Survivorship, and Not as Tenants in Common, the following described
real estate, situated in Story County, Iowa, to-wit:
Parcel B of the Plat of Survey of Lot Five
(5) , Ames Community Industrial Park
Subdivision, Ames, Iowa, filed in the office
of the Recorder of Story County, Iowa, on June
9, 1993, in Certificate and Field Notes Book
11, page 187;
subject to easements and restrictions of
record.
The grantors do Hereby Covenant with grantees, and successors
in interest, that grantors hold the real estate by title in fee
simple; that they have good and lawful authority to sell and convey
the real estate; that the real estate is free and clear of all
liens and encumbrances except as may be stated above. Grantors
covenant to warrant and defend the real estate against the lawful
claims of all persons except as may be stated above. Each of the
undersigned hereby relinquishes all rights of dower, homestead and
distributive share in and to the real estate.
Words and phrases herein, including acknowledgment hereof,
shall be construed as in the singular or plural number, and as
masculine or feminine gender, according to the context.
