That FORD STREET DEVELOPMENT COMPANY, an Iowa General
Partnership, having its principal place of business at Ames, Story
County, Iowa, and ERBEN A. HUNZIKER and MARGARET H. HUNZIKER,
husband and wife, and DEAN E. HUNZIKER, an unmarried person, for
good and valuable consideration, receipt of which is hereby
acknowledged, does hereby grant unto the City of Ames, Iowa, a
municipal corporation, its successors and assigns, the perpetual
right to construct, reconstruct, maintain, repair and use utility
services and apparatus upon, underground, over or across the
following-described real estate:
Lot Number Easement
Lot 1 The West 10 Feet;
Lot 2 The West 10 Feet and the South 10 Feet;
Lot 3 The East 20 Feet and the South 10 Feet;
Lot 4 The North 10 Feet and the East 20 Feet;
Lot 5 The North 10 Feet and the West 10 Feet;
Lot 6 The East 10 Feet and the South 10 Feet;
Lot 7 The East 10 Feet;
Lot 8 The East 10 Feet;
Lot 9 The West 10 Feet and the East 20 Feet;
Lot 10 The West 10 Feet; the East 20 Feet; and
the South 10 Feet;

The undersigned further grant unto the City of Ames,
Iowa, its successors and assigns, a perpetual storm water storage
easement as follows:
All that part of Lot 4 of Ames Community
Industrial Park Subdivision, Ames, Iowa, lying
West of a line described as follows:
Commencing at the North East corner of said
Lot 4 , thence S 890 13 ' 48" West, 289 . 0 Feet
along the North line of said Lot 4 to the
point of beginning, thence in a Southerly
direction to a point on the South line of said
Lot 4, said point being 280. 0 Feet West of the
South East corner of said Lot 4 .
The undersigned further grant unto the City of Ames,
Iowa, its successors and assigns, a storm sewer utility easement
on the North 10 Feet of Lot 4 of Ames Community Industrial Park
Subdivision, Ames, Iowa, and, in addition, the storm sewer utility
easement described as 10 Feet on either side of a line described
as follows:
Beginning at a point on the North line of said
Lot 4 which is 240 Feet West of the North East
corner of said Lot 4, thence South 290 13 ' 57"
West 99 . 3 Feet to a point on the East line of
the Storm Water Storage Easement Boundary
(above described) of said Lot 4, said point
being 86 Feet South of the North line of said
Lot 4 , and there terminating.
The foregoing rights are granted upon the express
condition that the users of the granted rights will assume
liability for all damage to the real estate described herein and
any adjacent real estate caused by the failure to use due care in
the exercise of the granted rights.

personally appeared Marvin J. Walter and John M. Botos, to me
personally known, who, being by me duly sworn, did state that they
are the President and Secretary, respectively, of Dayton Road
Development Company, an Iowa corporation which is a Partner of Ford
Street Development Company, an Iowa General Partnership, executing
the foregoing instrument; that no seal has been procured by the
corporation; that the instrument was signed on behalf of the
corporation as a Partner of Ford Street Development Company, an
Iowa General Partnership, by authority of the corporation's Board
of Directors; and that Marvin J. Walter and John M. Botos, as
officers of the corporation, acknowledged the execution of the
instrument to be the voluntary act and deed of the corporation and
of the partnership, by it and by the officers voluntarily executed.

appeared Richard T. Johnson, to me personally known, who, being by
me duly sworn, did say that he is one of the partners of JPR
Partnership, Ltd. , an Iowa General Partnership, and a Partner of
Ford Street Development Company, and that the instrument was signed
on behalf of JPR Partnership, Ltd. , as a Partner of Ford Street
Development Company, by authority of the Partners, and the Partner
acknowledged the execution of the instrument to be the voluntary
act and deed of Ford Street Development Company and of JPR
Partnership, Ltd. , by the partnerships and by the Partner
voluntarily executed.
