Coy, Husband and Wife; Richard Coy and Gretchen Coy, Husband and Wife; Broadmoor Enterprises, Inc. ; in consideration of the sum of One Dollar and other considerations, receipt of which is hereby acknowledged, do grant to the City of Ames, Iowa, a municipal corporation, its successors and assigns, the perpetual right to construct, reconstruct, maintain and use electric lines, consisting of poles, wires, cables, conduits, fixtures, anchors and other similar equipment, including the right to trim or remove trees within such area where necessary to secure a clearance of 4 feet from the wires or poles, together with the right to extend to telephone, telegraph, electric or power companies, or a company, the right to use separately or jointly with the City of Ames the areas included in this easement for the purposes above enumerated, over, upon, across or under the following described real estate, situated in the county of Story, State of Iowa, to-Wit: A 5 foot strip along the Southwesterly boundary of Lots 1, 2, 3, 4, 5, 6, 7, 8, 9, 19, 20, 21, 22, 23, 24, 25, 26, and 27; A 5 foot strip along the Northeasterly boundary of Lots 10, 11, 12 13 14 15 16 17 18 28 29 30 31 32 33 and 34; , , , , , , , , , , , , , A 5 foot strip along the Southeasterly boundary of Lots 1, 5, 8, 12, 15, 18, 19, 20, 22, 26, 31, and 34; A 5 foot strip along the Northwesterly boundary of Lots 4, 7, 9, 10, 13, 16, 21, 25, 27, 28, and 32; All in Allenview Seventh Addition to Ames, Iowa. The foregoing rights are granted upon the express condition that the City of Ames will assume responsibility for all damage to the above described property caused by the city's failure to use due care in the exercise of its granted right.
