AGREEMENT FOR PUBLIC IMPROVEMENTS
AIRPORT ROAD SUBDIVISION
THIS AGREEMENT made and entered into effective the 24 day of Qe—TDf3L2 ,
1998, by and between the CITY OF AMES, IOWA (hereinafter called the "City") and AIRPORT
ROAD DEVELOPERS, L.C. (hereinafter called 'Owner"),
WITNESSES THAT :
r WHEREAS, Owner did as a condition of approval f uhc plat of subdivision f;r Aiyrt Road Subdivision, enter into an "Agreement for Public Improvements" dated July 28, 1998; and,
WHEREAS, under said agreement the Owner is required to construct sidewalks along
the frontage of Airport Road; and,
WHEREAS, it is now mutually desired that the said sidewalk requirement be amended,
NOW, THEREFORE, the parties hereto have agreed and do hereby agree that:
1. The said agreement is amended to the effect that the Owner is not required to
construct a sidewalk along Airport Road.
2. The said agreement is amended further to require that the Owner shall construct
at Owners sole expense a paved walkway meeting the specifications of the City Department of
Public Works, a minimum of four feet in width, in the location shown in orange on the attached
copy of an aerial photograph of the site of the Airport Road Subdivision.
3. The said sidewalk shall be constructed at such time as when there are thirty or
more persons regularly employed at commercial or industrial activity during daytime hours in
a building or buildings located on Lot 8 of the said Airport Road Subdivision.
4. In all other respects, the said `Agreement for Public Improvements" shall remain
unchanged.
IN WITNESS WHEREOF, the parties hereto have caused this instrument to be
executed effective the date first above written.
