HomeMy WebLinkAbout~Master - Set date of public hearing for Iowa Farm House to receive portion of vacated alley RESOLUTION NO. 11-391 RESOLUTION PROPOSING THE CONVEYANCE BY QUIT CLAIM DEED TO IOWA FARM HOUSE ASSOCIATION OF SUCH RIGHT, TITLE AND INTEREST AS THE CITY OF AMES SHALL HAVE IN CERTAIN LAND CONSTITUTING PART OF A VACATED ALLEY; SETTING DATE, TIME AND PLACE OF PUBLIC HEARING THEREON; AND DIRECTING PUBLICATION OF NOTICE. WHEREAS, Ames City Ordinance 294 enacted April 16, 1917, vacated the alley platted in lot(4), Parker's Addition to Ames, Iowa; and WHEREAS, that vacated alley abuts a lot now platted as Parcel "C'; as shown in the "Plat of Survey" filed in the office of the Recorder of Story County, Iowa, on June 14, 2011, and recorded as instrument#11-05492 on Slide 408 Page 1; and WHEREAS, the owners of said lot ask the City for a Quit Claim Deed to a portion of the vacated alley in exchange for granting to the City a utility easement; NOW, THEREFORE, BE IT RESOLVED,by the City Council for the City of Ames, Iowa, that it is hereby proposed that the right, title and interest of the city of Ames, Iowa in certain land constituting a part of the vacated east half of the north/south alley in Gray and Cessna Subdivision of Lot 4, Parker's Addition to the City of Ames, Iowa, said land being more specifically described as: The east half of the vacated alley abutting Parcel "C"; as shown in the "Plat of Survey" filed in the office of the Recorder of Story County, Iowa, on June 14, 2011, and recorded as instrument#11-05492 on Slide 408 Page 1; said land not being necessary to city purposes, be conveyed to Iowa Farm House Association for and in consideration of the granting back to the City of such easement for utility and other purposes as are deemed necessary by the city's engineers. BE IT FURTHER RESOLVED that a public hearing on the proposed conveyance as aforesaid shall be held as required by law to coincide with the City Council meeting of September 13, 2011, which will begin at 7:00 p.m. in the City Hall, 515 Clark Avenue, Ames, Iowa.
