HomeMy WebLinkAboutA010 - Mortgagee's Consent to Platting and Partial Release dated January 18, 1999 f ' Attachment No. 1- AIRPORT ROAD SUBDIVISION, AMES, STORY COUNTY, IOWA MORTGAGEE'S CONSENT TO PLATTING AND PARTIAL RELEASE WHEREAS, First National Bank, Ames, Iowa, (the "Mortgagee") the present owner of the mortgage given by AIRPORT ROAD DEVELOPERS, L.C., to First Na- tional Bank, Ames, Iowa, under date of November 30, 1998, and filed in the office of the Recorder of Story County, Iowa, on December 16, 1998, and recorded as Instrument No. 98-17471 and therefore, Mortgagee has an interest in the real property described in the consent to platting to which this Mortgagee's Consent to Platting is attached; WHEREAS, the Mortgagee has been requested to consent to the platting of the real property described in the attached subdivision plat to be known as AIRPORT ROAD SUBDIVISION, AMES, STORY COUNTY, IOWA and deems it advisable to do so; WHEREAS, the Mortgagee has been requested to release the lien of said mort- gage with respect to certain tracts dedicated to public use within said subdivision plat; NOW, THEREFORE, for good and valuable consideration: 1. CONSENT. The Mortgagee agrees and consents to the platting of the real property described in the attached subdivision plat to be known as AIRPORT ROAD SUBDIVISION, AMES, STORY COUNTY, IOWA, to which this Mortgagee's Con- sent to Platting is attached. 2. PARTIAL RELEASE. The Mortgagee does hereby release the lien of said mortgage as to that certain real property dedicated to the City of Ames, Iowa, for public right of way (to be known as "Kitty Hawk Drive") and which public right of way is shown on the final plat of AIRPORT ROAD SUBDIVISION, AMES, STORY COUNTY, IOWA. This instrument constitutes a release of the lien of said mortgage only as to the real property described above and shall not affect the lien of said mortgage on the remaining real property described therein which shall remain in full force and ef- fect. airr.009 99 - 00730 t�� - 2 - IN WITNESS WHEREOF, the Mortgagee has caused this instrument to be exe- cuted on its behalf on January 18, 1999.
