RESOLUTION APPROVING THE SALE AND CONVEYANCE BY QUIT
CLAIM DEEDS OF SUCH RIGHT,TITLE,AND INTEREST AS THE CITY
HAS IN CERTAIN LAND CONSISTING OF VACATED PUBLIC RIGHT OF
WAY LOCATED AT SUMNER AVENUE SOUTH OF SE 2ND STREET AND
THE ALLEY SOUTH OF SE 2`D STREET IN KINGSBURY'S ADDITION TO
THE CITY OF AMES,IOWA
BE IT RESOLVED, by the City Council for the City of Ames, Iowa:
Section One. That on the 25th of January,2011,the City Council previously approved Resolution
11-32 proposing the sale of the right, title, and interest of the City of Ames, Iowa in certain land
constituting right-of-way property, described generally as the vacated portion of Sumner Avenue
south of SE 2nd Street and the vacated alley south of SE 2nd Street in Kingsbury's Addition to the City
of Ames, setting a public hearing thereon, and authorizing the publication of notice.
Section Two. That on this date, the 8`h of February, 2011, a hearing was held to receive public
comment and to consider the proposal to sell the said real estate as follows:
Beginning at the southwest corner of Lot 6, Block 3 of Kingsbury's Addition to the City
of Ames, Story County, Iowa, in the 5t1i P.M.; thence south 66' along the east ROW line
of Sumner Avenue; thence west 33' to the centerline of Sumner Avenue; thence north 66'
along said centerline; thence east 33' to the point of beginning; Containing 2,178 square
feet; and
The east 8' of the south 66' of the Alley, Block 3 of Kingsbury's Addition to the City of
Ames, Story County,Iowa, in the 5d'P.M.; Containing 528 square feet;
Said sale being by Quit Claim deed to JMH Corporation for and in consideration of payment to the
City of Ames of the sum of seventeen thousand two hundred sixty dollars and eighty-five cents
($17,260.85) and the grant to the City of Ames of a public utility easement across said property.
Additionally, the interest in certain land constituting a public right-of-way described as:
The north 132' and the west 8' of the south 66' of the Alley, Block 3 of Kingsbury's
Addition to the City of Ames, Story County, Iowa, in the 5`h P.M.; Containing 2,640
square feet; and
Beginning at the northeast corner of Lot 1,Block 4 of Kingsbury's Addition to Ames,
Story County, Iowa, in the 5'P.M.; thence east 66' to the northwest corner of Lot 2,
Block 3 of Kingsbury's Addition; thence south 198' along the east ROW of Sumner
Avenue; thence west 33' to the centerline of Sumner Avenue; thence north 46' along said
centerline; thence west 33' to a point on the west ROW of Sumner Avenue; thence north
152' to the point of beginning; Containing 11,550 square feet;

Said sale being by Quit Claim deed to BMB Land Company, L.C. for and in consideration of
payment to the City of Ames of the sum of ninety thousand three hundred ninety dollars and one cent
($90,390.01)and the granting back to the City of such easements over said land for utility and other
purposes as shall be deemed necessary by the City's engineers.
Additionally, the interest in certain land constituting a public right-of-way described as:
Commencing at the northeast corner of Lot 1, Block 4 of Kingsbury's Addition to the
City of Ames, Story County, Iowa, in the 5"'P.M.; thence south 152' along the west
ROW line of Sumner Avenue to the point of beginning; thence south 112' along the west
ROW line of Sumner Avenue; thence east 33' to the centerline of Sumner Avenue; thence
north 112' along said centerline; thence west 33' to the point of beginning; Containing
3,696 square feet;
Said sale bing by Quit Claim deed to BBNC, LLC for and inconsideration of payment to the City
of Ames of the sum of twenty-seven thousand nine hundred one dollars and seventy-eight cents
($27,901.78) and the granting back to the City of such easements over said land for utility and other
purposes as shall be deemed necessary by the City's engineers.
Section Three. The City Council now finds that said real estate is not necessary for City purposes
and authorizes the Mayor and City Clerk to execute on behalf of the City of Ames, Iowa, Quit
Claim Deeds as described in Section Two, reserving to the City public utility easements across
said property.
Section Four. The City Council authorizes the City Clerk to deliver said deeds only after
adoption of an ordinance vacating the public way at Sumner Avenue south of SE 2nd Street and
the alley south of SE 2nd Street in Kingsbury's Addition and upon receipt of payment as provided
in Section Two.
