HomeMy WebLinkAbout~Master - Public hearing date for sale/conveyance of Sumner Avenue R-O-W RESOLUTION NO. 11-032 RESOLUTION PROPOSING THE SALE AND CONVEYANCE BY ' QUIT CLAIM DEED TO JMH CORPORATION, BMB LAND COMPANY, LC, AND BBNC, LLC, OF SUCH RIGHT, TITLE, AND INTEREST AS THE PARTIES SHALL HAVE IN CERTAIN LAND CONSISTING OF RIGHT-OF-WAY LOCATED IN THE CITY OF AMES, IOWA; SETTING DATE, TIME, AND PLACE OF PUBLIC HEARING THEREON, AND DIRECTING PUBLICATION OF NOTICE. BE IT RESOLVED,by the City Council for the City of Ames, Iowa: Section One. That it is hereby proposed that the right, title, and interest of the City of Ames, Iowa in certain land constituting right-of-way property, said land not being necessary to City purposes, shall be sold and conveyed as follows: Beginning at the southwest corner of Lot 6,Block 3 of Kingsbury's Addition to the City of Ames, Story County, Iowa, in the 5th P.M.; thence south 66' along the east ROW line of Sumner Avenue; thence west 33' to the centerline of Sumner Avenue; thence north 66' along said centerline; thence east 33' to the point of beginning; Containing 2,178 square feet; and The east 8' of the south 66' of the Alley, Block 3 of Kingsbury's Addition to the City of Ames, Story County, Iowa, in the 5th P.M.; Containing 528 square feet; to JMH Corporation for and in consideration of payment to the City of Ames of the sum of seventeen thousand two hundred sixty dollars and eighty-five cents ($17,260.85) and the grant to the City of Ames of a public utility easement across said property; and Additionally, it has been proposed that the right, title and interest in certain land constituting a public right-of-way described as: The north 132' and the west 8' of the south 66 of the Alley, Block 3 of Kingsbury's Addition to the City of Ames, Story County, Iowa, in the 5th P.M.; Containing 2,640 square feet; and Beginning at the northeast corner of Lot 1, Block 4 of Kingsbury's Addition to Ames, Story County, Iowa,in the 5th P.M.;thence east 66' to the northwest corner of Lot 2, Block 3 of Kingsbury's Addition; thence south 198' along the east.ROW of Sumner Avenue; thence west 33' to the centerline of Sumner Avenue; thence north 46' along said centerline; thence west 33' to a point on the west ROW of Sumner Avenue; thence north 152' to the point of beginning; Containing 11,550 square feet; Document in ProLaw i be conveyed by Quit Claim deed to BMB Land Company, L.C. for and in consideration of payment to the City of Ames of the sum of ninety thousand three hundred ninety dollars and one cent ($90,390.01) and the granting back to the City of such easements over said land for utility and other purposes as shall be deemed necessary by the City's engineers. Additionally, it has been proposed that the right, title and interest in certain land constituting a public right-of-way described as: Commencing at the northeast corner of Lot 1, Block 4 of Kingsbury's Addition to.the City of Ames, Story County, Iowa, in the 5th P.M.; thence south 152' along the west ROW line of Sumner Avenue to the point of beginning; thence south 112' along the west ROW line of Sumner Avenue; thence east 33' to the centerline of Sumner Avenue; thence north 112' along said centerline; thence west 33' to the point of beginning; Containing 3,696 square feet; be conveyed by Quit Claim deed to BBNC, LLC for and in consideration of payment to the City of Ames of the sum of twenty-seven thousand nine hundred one dollars and seventy-eight cents ($27,901.78) and the granting back to the City of such easements over said land for utility and other purposes as shall be deemed necessary by the City's engineers. Section Two. A public hearing on the proposed conveyance as aforesaid shall be held as required by law to coincide with the City Council meeting of February 8, 2011, which will begin at 7:00 p.m. in the Ames City Hall, 515 Clark,Ames, Iowa.
