HomeMy WebLinkAbout~Master - Easement for Greenbriar Park golf cart path RESOLUTION NO. 10-531 RESOLUTION ACCEPTING EASEMENT AGREEMENT FOR GREENBRIAR PARK GOLF CART PATH FOR THE CITY OF AMES WHEREAS, in 2009,the City Council had approved stormwater management improvements near Greenbriar Park to reduce flooding in that park, as well as on the nearby Coldwater Golf Links; and, WHEREAS,the project involved redirecting the unnamed creek in that area,but in order to do that, one of the crossings used by golf carts to get from one part of the course to the other had to be eliminated; and, WHEREAS, in going forward with that project,an agreement was reached with the owners of the golf course,under which the City would grant an easement at a different location for the golf carts to use in lieu of the path that was being eliminated; and, WHEREAS, the easement allows the golf carts to use the City's bike trail and cross its park land for a short distance between the segments of the course; and, WHEREAS,the agreement also binds the owners of the course to hold the City harmless from any liability arising from that use; and, WHEREAS, the signed easement documents have been received by the City, and the Council is asked to accept these documents. NOW,THEREFORE,BE IT RESOLVED by the City Council of the City of Ames,Iowa,that acceptance of the easement agreement for the Greenbriar Park Golf Cart Path is hereby approved.
