HomeMy WebLinkAbout~Master - Waiver of subdivsion requirements for Grand Aspen, 4th Addition RESOLUTION NO. 10-510 RESOLUTION APPROVING WAIVER OF SUBDIVISION REQUIREMENTS FOR IMPROVEMENTS IN PROPOSED GRAND ASPEN SUBDIVISION, 4TH ADDITION, FOR THE CITY OF AMES WHEREAS, Randall Corporation has submitted a request for a waiver of subdivision requirements for public improvements for the Grand Avenue right-of-way in the proposed Grand Aspen Subdivision, 4tn Addition; and, WHEREAS, the purpose of the request for a waiver is to allow approval of the final plat for Grand Aspen Subdivision, 41h Addition, as a"minor subdivision,"not as a"major subdivision"; and, WHEREAS, a final plat for a minor subdivision is being processed concurrently with the request for a waiver; and, WHEREAS, the proposed subdivision includes three lots—Lot 1 is planned for development in the High-Density Residential zone and includes 13.16 acres; Lot A is the right-of-way for Grand Avenue, and Outlot D is an unbuildable lot that includes 0.19 acres in the northeast corner of the subdivision; and, WHEREAS, public improvements planned for the Grand Avenue right-of-way include street paving, curb and gutter, street lights, street trees, a bicycle path along the west side of the street, and a sidewalk along the east side, subject to approval of the Developer's Agreement for this subdivision; and, WHEREAS, the developer is to dedicate the Grand Avenue right-of-way to the City, and the City will be responsible for the installation of the improvements; and, WHEREAS,a division of land is classified as a"major subdivision"if the subdivision includes three or more lots, and/or there is a requirement for the construction of public improvements as part of the subdivision; and, WHEREAS, Grand Aspen Subdivision, 41h Addition, is a "major subdivision," since public improvements are required as part of the subdivision; and, WHEREAS,a"minor subdivision"is the division of land into no more than three lots,with no requirements for public improvements,and approval of a"minor subdivision"requires only a final plat; and, WHEREAS,the developer requests that the City process the proposed subdivision as a"minor subdivision" to expedite the approval process, thereby saving the time it would otherwise take to process the preliminary plat; and, WHEREAS, in this case, since the Developer will not be responsible for installing the Grand Avenue right-of-way improvements,it is similar to a"minor subdivision,"and it can be concluded that the requirements for public improvements is being adequately addressed in the Developer's Agreement, therefore, the waiver of requirements for improvements for the Grand Avenue right-of-way is appropriate. NOW,THEREFORE,BE IT RESOLVED by the City Council of the City of Ames,Iowa,that the request to waive the subdivision requirements for public improvements in Grand Aspen Subdivision, 4t'Addition, is hereby approved, subject to approval of the Developer's Agreement for this subdivision.
