RESOLUTION APPROVING CHANGE ORDER FOR
CLEAN AIR ACT LEGAL AND ENGINEERING CONSULTING SERVICES
FOR THE CITY OF AMES
WHEREAS, in September 2009, the City Council approved an engagement and retainer
agreement with Ritts Law Group of Alexandria, Virginia, for legal services related to regulatory
compliance issues under the Clean Air Act; and,
WHEREAS,for the initial agreement,the Council authorized an expenditure of an amount not
to exceed $100,000; and,
WHEREAS, during the past 12 months,the Ritts Law Group has worked closely with Electric
Services and the Legal Department to evaluate the projects scheduled at the steam electric plant and
the combustion turbines, and the evaluation was necessary to determine the applicability of Clean Air
Act regulatory requirements; and,
WHEREAS, with the assistance of legal and engineering consulting from Ritts Law Group, a
request to the Iowa Department ofNatural Resources for non-applicability determination was submitted
and is now pending; and,
WHEREAS,the total amount paid,to date,under the retainer agreement exceeds$90,000,and
it is anticipated that the need for consulting assistance will continue until the pending regulatory issues
are clarified and resolved; and,
WHEREAS, additional funding will be required,therefore,staff is requesting authorization to
extend the engagement with Ritts Law Group for an additional amount not to exceed $50,000.
NOW,THEREFORE,BE IT RESOLVED by the City Council of the City of Ames,Iowa,that
the Change Order in an amount not to exceed $50,000 for Clean Air Act legal and engineering
consulting services with Ritts law Group of Alexandria, Virginia, is hereby approved.
