HomeMy WebLinkAbout~Master - Waiver of subdivision regulations for property on 265th Street RESOLUTION NO. 10-331 RESOLUTION APPROVING WAIVER OF SUBDIVISION REGULATIONS FOR PROPERTY LOCATED AT 265TH STREET FOR THE CITY OF AMES WHEREAS,the owner of property located on 265t'Street has requested a waiver of the City's subdivisions standards, as she is proposing a subdivision of land located within two miles of the corporate limits of Ames; and, WHEREAS,the proposed division of land is a two-lot split of a 40-acre fractional parcel;and, WHEREAS,one lot is six acres,on which a home is proposed to be built,while the remainder is 34 acres and will remain in agricultural production; and, WHEREAS, since the proposed six-acre lot was once the site of a homestead, the redevelopment of the lot for residential uses is consistent with the Ames Urban Fringe Plan; and, WHEREAS, the remaining 34-acre is too small by County zoning standards to be developed for residential purposes and will remain in agricultural production; and, WHEREAS, the Council has routinely granted waivers for residential development in those areas of the Urban Fringe where annexation by the City is not anticipated in the foreseeable future;and, WHEREAS,ifthe City Council were to waive the infrastructure requirements,the owner could proceed with the preparation of a minor final plat for consideration, and along with the final plat submittal, the applicant would also submit covenants binding the owners in connection with annexation, assessments for future public improvements, and buy-out of rural water. NOW,THEREFORE,BE IT RESOLVED by the City Council of the City of Ames,Iowa,that the request to waive subdivision regulations for property on 265`' Street is hereby approved, subject to the following: 1) within six months of the date of the approval resolution, receipt of signed covenants that a)agree to annexation at the time the City requests,b)waive objections to assessments that may be imposed in the future if public improvements are necessary,and c)pay any fees associated with the buy-out of rural water; and, 2)receipt of an application for a final plat.
