RESOLUTION APPROVING AMENDMENT TO DEVELOPMENT AGREEMENT
FOR RINGGENBERG PARK SUBDIVISION
FOR THE CITY OF AMES
WHEREAS, land located southwest of Cedar Lane and Oakwood Road has been platted as
Ringgenberg Park Subdivision, and there was a Developer's Agreement executed at that time; and,
WHEREAS,the Developer's Agreement contained provisions addressing a number of details
of the project,including restrictions indicated which street would be designated for driveway access
for a number of the corner lots in the subdivision; and,
WHEREAS, earlier this year as Lot 9 was being prepared for sale and construction of a
single-family home,the City was approached about changing the Developer Agreement's driveway
access restriction as it related to that Lot; and,
WHEREAS, due to the orientation and the dimension of Lot 9, it is very difficult to build
with its driveway access onto Cottonwood Road,and currently,the Lot's only street access is to this
road; and,
WHEREAS,the developers are requesting to remove the restriction and allow Lot 9 to have
driveway access on Cedar Lane; and,
WHEREAS, staff reviewed the situation and believes that the driveway access for this Lot
can be changed without any adverse effects on traffic flows or traffic safety.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Ames, Iowa,
that the amendment to the Developer's Agreement for Ringgenberg Park Subdivision to allow the
change in driveway access onto Cedar Lane for Lot 9 is hereby approved.
